Black Horse Car Loan and ROG order - Warrant for repossession of my car tomorrow morning @730am by a Bailiff

Hi 

I have just received a judgement of delivery of goods order

this isn’t a surprise as this has been going on for some time now

what I am surprised about is the fact that this is the 3rd hearing and one which I wasn’t aware of. 

 

The creditor is black horse and I missed almost 8 months of payments due to redundancy and Ill heath,

despite being back employed and trying to negotiate with Black horse they took me to court which they had to as I had paid nearly half of the loan back.

 

Twice I have been to court and twice black horse didn’t turn up much to the judges dismay and typically they turned up to this one.

I honestly wasn’t aware of the new date otherwise I would of been there for sure as I wanted to get my facts across for the judge for what ever reason

 

I never received a letter from the court with the new date and also nothing from black horse.

The judgement is now saying that I have to return the vehicle by the 25th of November

is there anything I can do to at least get my point across to the judge ?

Hi I know this seems last minute dot.com but I was dealing with Black Horse through the courts prior to Covid, they issued a warrant and I managed to get it suspended and then covid happened and I didn't hear from them again until a few weeks ago telling me to take the car back.

 

I wrote back to them and offered a fair repayment plan and explained my situation, i didn't hear back from them and then I got a warrant delivered by a Bailiff 2 weeks ago, the warrant is for me to pay back the loan in full plus costs which there are not any, if I don't then the Bailiff will collect the car @730am tomorrow the 9th April and levy my house for Costs.

 

I emailed the court and attached an N245 form and a witness statement to try and get the warrant suspended this was over a week ago, I didn't hear anything back so emailed again I have also phoned the enquiry line and they said that there has been no updates, I emailed again and marked urgent

 

today I phoned the enquiry line and they told me to go to the court which i did. When I got there the security told me that I had to make an appointment or email them or call them. I handed him my documentation but he said that this has to go via the post box so I had to go and buy an envelope and hand wrote everything on the front asking them to call me. 

 

I still have not heard anything and I really just want to know where i stand in this situation as it is worrying the hell out of me I have suffered a lot with mental health and I am worried what this will do to me.

why did you not do the time order as advised before ?

Hi Dx my words where on the application notice "may i ask the court for a time order under s129 and to freeze interest and charges accusing on the debt under s136 in consequence"

 

The judge didn't do this she just suspended the warrant and then Covid happened, an update is that I have had a phone call from the court and I have a face to face hearing tomorrow @12pm bearing this in mind how do you think I should deal with the judge tomorrow what is the best outcome for me considering the circumstances.

just do a time order it will solve everything

you don't have to 'ask' permission of any judge to do one..
