No don't submit that yet ...Im currently working on it although with great difficulty as there is very little information to how the debt was incurred if there was any disputes and why such a large alleged debt was incurred ?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

It seems overdales have decided court it is. :-(

Sent me a letter stating I have till the 9th of September to get in touch or they will be sending a consent application.

 

oh well thanks for all the assistance but I won't get anywhere in court unfortunately.

How do you know you wont get anywhere in court ?  How do you know this will even get to court...they have to respond to the defence first then it has to be allocated to track. Have you received a Directions Questionnaire N180?

 

What consent are they sending and for what ?

Standard response if you wish to indulge in their offer before they have to shell out for the hearing fee. I suspect you cant afford that so ignore them and let them proceed to allocation...they do make me laugh " Internet Defence "...:becky: 

 

Beats their template particulars and witness statements.....which are on every court claim topic on this forum.

OK Thanks again. I was just worried because I read on here that the judge awarded a similar case to the debt collection agency and qouted some case saying assignment is legal and I don't have any sort of defence. I just don't want to get to the stage where I  have to go court and the judge says you have to pay it all in a sum sum which will be impossible.

We 99% win all Lowell claims the ones we cant protect against are judge lottery as no one can

 

but as Andy says thats a std begging letter they always sent to intimidate people.

Even if you did lose...you wont be required to pay in full by date.....simply submit an N245 and request an affordable monthly payment.

Thanks dx i've read quite a few of these will keep reading. Just waiting for my directions questionnaire. Overdales have sent theirs to me. I've noticed none of the boxes have been ticked for example the mediation service boxes haven't been neither yes nor no. Same for the small track nothing ticked.

 

Only the hearing venue to be by phone.

 

is this normal?

This is all I can see.

 

My only concern is that they have the full statement with all the transactions from shop direct how would the judge  not give judgement in their favour?
