    • The Tories election campaign is basically whatever the Daily Mail and Express write about as concerns of the 'British people'.  The latest speech by Sunak about sick note Britain is the latest. Perhaps there needs to be a discussion on the mental health crisis that is stopping a large number of people from working.  When people are having to wait for months for a Mental Health assessment and then a very long time for any therapy treatment, then that is not going to help. The problem with many politicians speeches is that they identify problems, but when it comes to solutions that are going to cost billions, plus take many years to put into place, they shy away from the practical actions that would be required. Instead they will come up with some slight tinkering actions at a cheaper cost, that won't make much difference.  There are probably  hundreds of thousands of disabled people who would like to work, but many employers won't offer them employment as they are not willing to make the reasonable adjustments to make it happen. If the Government pledged to support employers financially with the costs that would be incurred, then I am sure we would see many more disabled people in workplaces.
    • yeah the outstanding balance is correct as I was already in a payment plan with hmrc up till about a year ago when they suddenly stopped taking payments from my bank so me being naive I just left it assuming they would get back in contact to resume payments but instead I got this letter.. I am just glad it won’t show on my credit file as I have only just got it to excellent   
    • I've had a look on their site to see if there is a way to download photos, but haven't found anything. The best thing is to send them a SAR on Monday.  Invest in a 2nd class stamp and get a free Certificate of Posting from the post office. That way they will have to produce the original invoice, a windscreen ticket if it exists, photos, etc.  
    • So today I’ve recieved a letter from J&P after a long time this time with forms attached to respond back about how much I can repay etc and that if I do not respond within 30 days court proceedings will apply   I had wrote to NBD bank to inform them of my new address and to resolve this matter last month, but I haven’t had any confirmation or heard back from them. Should I write to them again?
    • Not consumer credit, so won't show on credit records. Are you 100% sure the Tax Credits payment is correct ? Did you receive an overpayment letter ? If not, there is no immediate need to set up a payment plan. Contact HMRC submitting a subject access request and if there is doubt about the overpayment amount, write to ask HMRC for a breakdown calculation of any overpayment amount. Make a subject access request to HMRC - GOV.UK WWW.GOV.UK Find out how to ask for access to personal data that HMRC holds about you, or someone who has died.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, first of all like everyone that gets caught, I’m very very ashamed of myself but glad I got caught. Let me just explain as quickly as I can, not wanting sympathy or anything like that.

 

2019 I got diagnosed with breast cancer (that’s when it started) I for some reason started stealing things of little value to give to the charity  Brest cancer research. This has continued until I released I needed help. I’m showing all the symptoms of  Kleptomania but too ashamed to get help. I also suffer with Crohn's disease.

 

I went to B and Q to get a few items, then I had the urge to steal things I didn’t need. To cut a long story short, I got caught and escorted to a little room. I told the security guards I needed the toilet as I have Crohn's disease, he just ignored me and told me to sit down, I constantly told him I really needed to toilet and showed him my medical card but just got ignored


I can’t remember everything he said because the inevitable happened (i soiled myself) I just remember him saying I would get a fine from CRS for £218 because the items I hadn’t paid for came to £31. 
 

As a Crohn’s sufferer I’m used to accidents but so upset this happened when it could have been avoided but that’s not my concern. I’m now worried about the fine, I have little income and don’t know how I’m going to pay it. I can’t sleep for worrying, I darn’t leave the house, but I know I’ve brought this on myself so I deserve everything I get.

Welcome to the forum. I'm going to move this thread to another part of this website where there are other people who have posted questions involving shoplifting.

If you read around our responses there, you will find that we are not judgemental but we do try to give advice – including the fact that you should go and see your GP about this and tell them everything.

Not only will you get help but you will probably feel much better that you shared this with someone. Also if you have somebody close to you/that you trust – it would be a good idea to share it with them as well. I'm sure there will be initial humiliation – but afterwards you will feel much better about and about yourself.

It sounds to me as if you had pretty harsh treatment from B&Q and we can help you to make a complaint about that but I expect that you'd rather not. I think you would probably be right.

Presumably the items which you took were either returned in perfect condition or else they were paid for.

Either way, you don't need to worry about paying a so-called "fine". What you are being threatened with is a letter from some kind of firm which tries to make money on the back of people in your kind of difficult situation which instead of making life easier, simply makes life more difficult.

If you get a letter from some company demanding money then come here because we are used to handling them. By and large though you should ignore them.

You say that you deserve everything you get. – I think you obviously deserve a bit of remorse and a bit of reflection – but other than that you are probably beating yourself up unnecessarily. You should certainly leave the house. There's no point in staying in – and you will get over it that certainly use this opportunity while you are energised about it to go and talk to people – your GP.

No items were damaged and no loss to B and Q.
I’m just so ashamed of the accident I had I felt so degraded when I asked for help.

Just make sure that you go and talk to people as quickly as possible and tell them everything that happened. I'm sure that you will feel really good about it.

Oh dear - You have got yourself in a pickle havent you. 

CRS are Civil Recovery Solutions if I remember rightly of Post Code NG8. (B&Qs chosen partner)

Noto be confused with Credit Resource Solutions of Post Code HX3.

 

I'm pretty sure that you can ignore the "Fine" they send. Personally even if you didnt - I wouldn't be giving them details on an unsecure site. ;)

And as for someone who has been where you are (Without the shoplifting part :) ) I can assure you arranging some time with your GP via Video Conferencing is the right thing to do :)

its to line their own pockets to fund the harassment of other poor soles with the same medical and emotional issues as you

 

the security guard that used that work knows he is lying and would have had training at being told NOT ever to call it a fine. oh and as far as i know with CRS he gets a backhander too!

it's fake and they have absolutely zero legal powers to do anything

 

just like any DCA on any consumer debt - they are NOT bailiffs.

they are totally powerless.

A threat of bailiffs is an empty threat. There would have to be a court judgement first.

Once again, don't worry about it. Put it behind you – but go and talk to someone

Crohn's experience in the family so I get just how humiliating this was for you. Unforfgiveable and totally taking advantage of your lack of knowledge and your vulnerability.

 

If you wanted, you could take on B&Q and the security guard to get the justice you deserve, but ..........

 

.......... I'm sure you would be happier letting it fall into the background, then disappear.

 

Let us know if you get any further threat/demand but please be assured they can do nothing at all to fine you, or affect you in any other way.
