Thanks...read......as I have already pointed out.....you cant act or respond for a defendant (Your Daughter ) in the issuance of a claim. In this instance your only options are to send it to the 1st defendant named on the court claim...(after taking full copies and retaining the originals )and lets hope that they can make contact with your daughter and have her current address.

 

They will act and deal with this claim against her...they are/were her insurers at the time of the RTA.

 

If you still feel you should send something...then I would only advise the 1st two paragraphs....and add that their claim even if successful is pointless as they will never be able to enforce any judgment given your daughter is on the MARAC list and therefore unreachable.

You could attach your letter in full and pics and send that also with the claim form to the 1st Def...but adapt the letter so its to the 1st def.

We could do with some help from you.

I was just about to email both insurance and solicitor but there are missing pages from this claim form the summons page the log in details and the place of hearing and date is missing !

 

The online system says there is no such case number?

 

This is blarney isn't it ?

 

Surely this in itself is illegal?

 

If this was a summons then the court would have had to serve it wouldn't they ?

 

When I have to do a money claim online to recoup my sons money after being sold a dud car they had to send it and I nearly had to pay twice as the first time i put the address down as 296A when it was meant to be 296B

salford claims dont use MCOL.

and claimants can issue forms directly

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Also I'm a little confused because it says her insurance have paid her out but she is claiming the money again?

 

Either way the court should have issued documents also no?

 

So I'm a little dim hey :) won't have claim form until which time someone responds to say they are going to defend the claim :)

There is a Claim Form, but was there nothing else enclosed? It seems to have been sealed by the Court too so is legitimate. 

 

As has been mentioned, you can't reply or deal with this claim on anyone else's behalf or argue the case etc. 

 

Pass it immediately to the insurance company to deal with, although they probably already have. 

 

The repairs outlay is being recovered on behalf of the insurer as part of the Claimant's claim. Perfectly normal.
