Hi Guys. 

 

Paypal amended their legal. agreement due to Brexit. 

 

One of the paragraph states:

 

Regulatory Authorisation

PayPal is regulated by the Commission de Surveillance du Secteur Financier (CSSF) in Luxembourg with authorisation number 23/07. The CSSF is the authority responsible for the prudential supervision of companies in the financial sector in Luxembourg.

 

In addition to CSSF regulation, from January 1, 2021 PayPal will be deemed to be authorised and regulated by the Financial Conduct Authority. The nature and extent of consumer protections may differ from those for firms based in the UK. Details of the Temporary Permissions Regime, which allows EEA-based firms to operate in the UK for a limited period while seeking full authorisation, are available on the Financial Conduct Authority’s website.

 

I have a negative balance with them but I was ignoring it since Sep 2020 because it wasn't my fault and I took advise from this forum to ignore their demands. 

 

Is this change of the agreement means that they have more rights now to chase the money back?

no. as a negative seller/buyer A/C is still not regulated by the consumer credit act 1974 either.

unlike paypal uk or newday uk credit which is offered by them and already CCA regulated.

paypal credit is where you separately click on the UK site and takeout/enter into an online consumer credit agreement for them to either loan you money or operate a paypal branded credit card.

 

both of which are regulated by the UK consumer credit Act 1974, and offered by Paypal Uk or Newday Cards respectively .

 

a seller/buyer Paypal A/C is neither of those.

Hi Guys. 

Paypal blocked my main account due to not clearing my negative balance. 

I can't acces my paypal credit account so I'm not able to see my balance, charges etc. 

Do you know if that's legal? Any help would be much appreciated

Paypal Uk I believe. And yes is on my credit file

I'm not in arreas and outstanding balance is £531 which I want to carry on paying off.

Hi. It was my negligence. Paypal sold the debt to Moorcroft. At the moment Im ignoring them. But not sure what to do next

Paypal dont sell debts.

Moorcroft are not a dca debt buyer

They are only ambulance chasers for their stated client

And as with all DCA's..they are not BAILIFFS

And have

ZERO legal powers on any debt no matter what it's type

Pay it by bacs transfer then from your banks webportal

They don't want to provide any bank details so I do payments over the phone. But until now I could at least check my balance and charges before I made a payment.

They should be writing with regular statement s unless this was on online account only , but they Should still be sending montly statement s by email that should include payment details.

 

You should never be ringing anyone and paying by phone/card

How can I force them to provide bank details? They insisting that the payments over the phone is the only way. So far I was using same phone number and payments went through. They even send a confirmation email about the payment. 

And I don't get any kind of statements. Only on my paypal account which is now blocked.

raise a Complaint that you wish now to receive monthly bills and statements by post or email

 

And be given details to set up a direct debit or standing order.

 

Your paypal credit account and your negative paypal user account are two totally separate things.

 

Have you a copy of the agreement you signed with paypal credit uk still when you started?

Just phoned them again. 

They do not have a bank accounts for me to set up direct debit or standing order. They offer to send statement over the post but with £5 charge every month. They don't send statements through emails. And again they're insisting that making payments is only available over the phone. 

I do not have copy of the agreement with paypal credit.

No good keep phoning these people as youll never have any paperwork trail when you complain to the fos/fca/ico

 

so go up on the fca register site

or companies house

and find their address and formally complain
