Hello,

this is my first post.

I have had a quick read of previous posts but I wanted to make sure I’m doing the right thing.

I received a charge certificate for £195 on the 28th of January for stopping on a bus stop, I did it not going to argue about that, but I never received the original PCN.

The charge certificate says the PCN was sent on 25/12/2020 and the date of offence is 14/12/2020.

I went online and looked at the evidence and there was a section for appeal so I filled it in and got a reply by email saying I would get a response in writing.

Its 14 days later and no response plus the time to pay the £195 ends today so it will be registered with the county court.

Do I wait for the order of recovery and appeal again?

I don't think it's a question of "appealing" now?  When you receive the OfR it should give you the option of making a stautory declaration to the effect that you never received the original PCN.

 

That then revokes the CC and OfR, but the council are able to reissue the PCN allowing you to restart the challenge procedure from the beginning.

 

I may be wrong, but if I am, I'm sure someone will correct me

Isn't it better to wait for the OfR?  The OP doesn't want to risk confusing the parking people at the council by jumping the gun - they dont't deal with unusual situations very well at the best of times...

The pcn was issued xmas day for an offence on the 14th dec

the op did not get the pcn. The time limit to pay £195 is today.

 

for whatever reason... if you did not receive a pcn you should issue an SD .then regardless to whatever has or is about to happen to date is all negated

 

if you are then sure you do owe you'll be able to take advantage of the reduced sum not £195 .......should your gamble on your appeal not being successful??

So this morning I received a letter from Greenwich parking services apologising for a system error, apparently the charge notice was sent out instead of a PCN and due to this procedural error they have cancelled the PCN.

Thank you for your help.
