      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

It appears to be that time of the year when many IT manufacturers are issuing major updates to their operating software.

 

Yesterday spent several hours trying to get a Samsung phone to work.  It had uploaded a new system update and then would not restart properly.  And as it a was a major update, had to clear data and do a reboot.  Spent time on another computer finding out what I needed to do, to get my phone working. Eventually it worked !  Preparing for the next time it uploads the same faulty operating system update.  Found out by searching that Samsung users in many countries have had the same problem.

 

Have also noticed that on my other devices there appears to be an increase in software updates, so I am preparing myself, by finding out how to fix problems.

 

 I had become a little bit complacent as I have been using mobile phones and computers for decades now, so thought I was up to date with operating systems and how to fix problems.  How wrong was I ?  I probably have less IT knowledge now than an average 10 year old !

 

Thought it was worth posting a comment, just as a reminder of the need for people to find out the latest ways to tackle basic user problems with the devices they own.  What buttons do you need to press and for how long do you hold them in for, to access an operating system menu, safe mode etc.  What should you do, to try to get your systems working again ?  What you should not do ?  

 

So my task over the next few weeks is to do some research on the devices I own, reading operating manuals, reading the manufactures website on fault fixing, watching Youtube videos etc. Might just save me time and money in the long run !

if it's android 11 - check in software info - if it says One Ui 3.0 -

to get into recovery factory reset - plug in usb-c into phone and to pc and reboot phone and press volume up and power for a few secs and it will get your to recovery and just do a factory reset. 

 

if it's android 10  check if its 2.0 or 2.1 One Ui - just reboot phone press volume and up.

 

if your phone reboots and it semi bricks - you can go here on pc - download your phone software using this software - https://forum.xda-developers.com/t/tool-frija-samsung-firmware-downloader-checker.3910584/

 

choose your csc eg - btu if your euro and your samsung phone make - like mine will be SM-G985F for s20.

 

then once it's downloaded and decrypted automatic - you go to the folder and use 7zip to extract all firmware. you should see BL,AP,CP, HOME_CSC, OMC_CSC. 

 

download this https://odindownload.com/ it will download and install on your pc dont worry its virus free. most of the android scene use it to flash stock firmware,

 

you can also look on xda as it's the biggest android site.

 

reboot phone into download mode - volume down and power for a few secs it will go in to download mode.

 

open up odin.

 

connect phone - 

 

in the box you put AP in ap, BL in BL, CP in cp, if you want to do dirty flash (Not lose data) choose Home_CSC, press start,

 

this will fix your phone back to normal state.

Thanks for the Samsung/Android information. 

 

I will take the time to study the information provided to equip myself.

 

I am little bit confused, as I had a Samsung  11 Android update recently and the phone was working ok, but there was a message about UI version which I did nothing with. Then yesterday, I switched on phone as normal, it then restarted and seemed to go around in a loop constantly failing to restart properly , going into safe mode.  

 

According to the Samsung website, for my phone M31, it says the Android 11 update is due in April 2021, so not sure why it tried to update last week.  

 

The phone is working ok now.

We could do with some help from you.
