backdoor Lowell CCJ now warrant - Old Vodafone debt - although last invoice Nil

1) the defendant entered into an agreement with vodafone under account reference        .......** ('the agreement').    
         
2) the defendant failed to maintain the required payments and the service was terminated.     

                             

3) the agreement was later assigned to the claimant on 30/08/2018 and notice given to the defendant.                               

 

4) despite repeated requests for payment, the sum of £2,308.44 remains due and  outstanding.        

                         

and the claimant claims                      

a) the said sum of £2,308.44                 

b) interest pursuant to s69 county courts act 1984 at the rate of 8% per annum from the date of assignment to the date of issue, accruing at a daily rate of £0.506, but limited to one year, being £111.82           

c) costs

And  £111.82  interest on what is most probably if not all, early termination's fees for a service charges they no longer provide or cost them.

that must have been a very expensive 24mts? contract at its start to run up +£2k!!

Thats the point the contract was terminated Nov16 to upgrade to new number and new account and line was supposedly turned off.

Who ever did upgrade did not turn off old account and seem to have carried on billing.

I have copies of last invoices no balance carried forward! 

 

If it is any help to others,  Northants bulk said they could cut & paste claim particulars and email. Which they did 👍

So now you have the SAR rsponse, use it to identify how the data and comms log ties in with the demands for payment that then led to the court claim made against you.

 

There's a suggestion that an old contract was allowed to run on when it should have been superceded with a new contract - you need to nail this identifying the old and new phone/account numbers, date the old contract should have ended, charges that accrued subsequently for monthly fees and late or penalty fees, etc.

 

You need to produce info to back up the assertion that the CCJ was based on incorrect data.

Hi Mop,

 

I only ran through the SAR looking for any personal data you left showing.

 

Get a pen and paper, go through the narratives and note down the date and anything relevant to what led to the debt or CCJ.

 

If there's little or nothing to do with the debt or CCJ, that in itself is important.

 

Do your best and come back with results.

Narrative mentioned 6 x payments of £100  for payment plan but not £2.5k.

What I meant was simply - visible info or data can be useful, but sometimes stuff that is missing can also be relevant.

 

Just do your best over the weekend.

 

Then come back with a summary of info that will help build a case to challenge the CCJ.

Dispute with Vodafone and get copy invoices last invoice 2016 no balance on old number

I have invoices upto nov16 showing no balance brought forward just before upgraded.

 

you say above you have all the bills that state a zero balance up until nov2016

are they in the SAR return too,? and all the ones after nov 2016?

 

the account number in the poc is this the same number as on those bills you have?

and the number on the pages of the comms log you uploaded?

as the comms log appears to show payments were being made right through the period you say the bills you have all show £0? then being transferred to other invoice numbers  , do these invoice numbers the payments were transferred too match the invoice numbers show £0 balance you have?

Hi 

 

Found some pdf old invoices which show that a debt all of a sudden was raised in January 2016 from £74.28 to £719.45 thereafter lots of one non recognisable charges. The Invoice style changed format, and billing number format (changed to a B7 prefix). I cannot see where the extra £640 came from and the plan changed. I note from the SAR the operator states there was an error in SAR states "error occurs open new profile".

If the debt is found to be incorrectly calculated then you could potentially get a set aside at Lowell's cost if they agree with it. (Hmmmmm...)

 

Let us know what actions you have taken to get info from Voda.

The plot thickens

 

I have a screen shot of earlier invoice B7-99496*40 with same account number showing £50.42 no balance brought forward.

 

However, based on the invoices as sent to my wife 7/11/19 after I complained to Resolver and CEBR the same invoice in different format.

 

Surely they would legally would have legally been required to credit and rebill not just revamp on old invoice number?
