I live in scotland, received a letter today from scumone called DCBL claiming that they are owed £160 because "the driver was parked in contravention of the terms and conditions outlined on the signage and was agreed to by the driver when the vehicle entered and parked on private land."

 

I am the RK of the vehicle mentioned, the date of the alleged offense was 05/16.

 

This is the first I am ever hearing of this, I have had no previous correspondence or anything relating to what they are referring to. Since their call queues are 45+ people long I am not keen to wait on the phone and deal with this. What do I need to do?

Have you moved since 05/16?  It's likely that previous correspondence has gone to an old address.

 

Can you follow our upload guide and post up what they've sent please?

You don't owe them a penny.

All you have to do is not admit who was driving since the driver could be taken to Court.

 

DCBL are a particularly virulent [and vile] company who specialise in chasing lost causes.

[We stopped doing that after William Wallace].

 

They will keep on writing for a while threatening all sorts though maybe not hanging, drawing and quartering before they move on to someone else [PS I liked your scumone!]

 

Doubtless in the meantime they will increase the charges but the maximum they can charge is the amount on the PCN which will be £100 or less.

Yep, begging letter.  Debt collection agencies can do absolutely zilch - because it's not their debt.  Ignore.

 

Being in Scotland helps massively too, with no POFA and no trespass.

 

The only slight worry is that further down the line the parking company could issue court papers to you at your old address, and they would win by default as you'd know nowt about them.  So send the PPC a two-line letter quoting their PCN number informing them of your new address.  Get a free Certificate of Posting from the post office.

 

If you particularly want to get to the bottom of this, a week after the first letter send a SAR to the PPC, again with a free CoP.  It's free to SAR a company.

I feel sorry for the people who fall victim to these predators. I don't know anything about their claim. Am I required to take any direct action at this point? I have no idea who was driving the vehicle at the given date.

 

if I do send the ppc that letter, isn't that kicking the hornet's nest? I'd rather not have to fight with them especially given that this becomes statute barred in a matter of months.

and how are the court going to know its SB'D

if everything is done to an old address and you know nothing about it

 

get that letter off can't reset anything.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
