      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well I'm on a real downer tonight. :sad: I have read of so many being paid out over the last 7 days, which is absolutely great but I cant understand why mine has been going on so much longer and I am still waiting.

It looks like Nat West appear to have changed tactics and are paying out sooner. I guess that as I had already passed the point at which they are now paying out I will have to wait a good deal longer yet! I know envy is a really bad characteristic but Im only human so forgive me.

Yep you are right. What a difference a sunny day makes!! Am realistic enough to accept that the wait goes on, at least until March 1st when their response to the Draft Order needs to be in. Thanks for your supportive words:)

Believe me I know how frustrating it can be waiting and waiting and waiting.....

I think that Natwest appear to be settling most of these claims in bundles. My cheque, along with a few others that were paid out recently, was actually dated 02-Feb!!!! We've had to wait a further two weeks before actually receiving it through the post and in our hands 13-Feb. Go figures:rolleyes:

 

It'll be along anytime soon and as Take That say 'Have a little patience'!!!:D

In view of the fact that Nat West are setting a lot earlier now,and my bundle went in over a week ago do you think there is any thing to be gained from ringing Cobbetts to see how things are going?? If you think it is better to wait I will but am so impatient. I see threads saying they were paid out after one or two letters and wonder why I have been going for just short of three months.:)

Oh, fire fox, we are in the same boat!!!!!!!!!!!!!! I can so sympathise with your post on 16th Feb - that is exactly how I was feeling tonight - if only I'd read your thread before!

I'm also going to ring Cobbetts tomorrow....so if the line's engaged when you try you'll know it's me!

BTW, I hadn't realised that we have 14 days to reply with the court bundle and Cobbetts have 14 days after that. You learn something new every day.

 

I am rooting for you! Keep us all posted.

Rang Cobbetts today for a progress report and was told the cheque is in the post!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Hooooooray !!!!

Camping out under the letter box tonight! Just have to wait and see if it is for the correct amount now but have to say I feel absolutely elated and that is an understatement.:D :D :D :D :D :D

Deller - It is a relief and Im sure you know what it feels like!! My enthusiasm was fading of late as it was taking so long!! But everything comes to he who waits.Will post as soon as cheque arrives and I know how much. Then clear cheque, make donation and clear OD. great eh?:D

 

Muggins - No Im not , hee hee. She has done all the work on it and she made me add the avatar etc as you know so I think a huge foxy cuddle is in order at the very least.

:D Yes, the post man has been. Big screams all round in the foxy household. Yay.!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Cheque was written out on 9th Feb which was a whole week before I photocopied 300 bloody pages for the bundle. What a shower of s***ts. Its £50 short but not going to chase that. Cant tell you how good I feel. OH kissed the postie!!!!!!!:D

Cant explain my gratitude to all those of you who helped and supported me through the dark days. You know who you are so big, big, big thanks.
