An OAP friend is struggling to pay his service charges. He owns a long lease flat. The freeholders are a huge well-known entity. He is billed quarterly for internal and external service charges, both current and potential future expenditures. I've had a look at the charges. I'm not sure there's much I can do to query the amounts on his behalf ?? Although I wish I could as the charges are exorbitant. As an example - the block has been charged 3.5k for cleaning over the last year. In this same period the freeholders renovated one of their own flats and the stairs carpet and hall was covered in plastic. Thus there was no stairs to hoover. During lockdowns the cleaner just did not come - yet there was no reduction in the annual cleaning bill!! There's no lift, no concierge, no gardener or caretaker - just one contract cleaner who (in normal circumstances) comes once a week. There's an alarm and the contractor tests it once a week. His service charges are pretty much 1k/month. If he doesn't pay the charges the freeholder takes legal action - threatening repossession. He isn't earning. Has a small monthly pension. He has a small mortgage and the lender has stepped in 3 times to cover the service charges. But this is untenable. it's made me question how many other elderly leaseholders are living with the threat of repossession just because they can't afford to pay the service charges.... Is there any Govt scheme or Pension attached scheme that helps pay service charges?

Hi We are here to help but the way you have posted has confused matters as in your post#1 you did state you had an Ombudsman and it was Upheld and awarded £75. Then in post#4 you point out you tried to complete your complaint online to the Ombudsman and it wouldn't let you finish you also point out you have 2 different cases with Eon Complaints and they sent a Letter of Deadlock. So can you see our confusion and the reason we are asking for clarity as it seem you have been dealing with Eon Complaints Team all along and not the Ombudsman. Could you give us a breakdown of both Cases/Complaints that you have with Eon? Is the Letter of Deadlock to do with both Cases/Complaints or just one?

Apologies for the delay, Attached is the Letter of Claim, if you approve I will proceed with sending it Tuesday morning. Then send a courtesy email to parcel2go that, a Letter of Claim has been sent and they have 14 days to respond. Thanks Parcel2Go Letter of Claim.pdf One more thing that I forgot to ask was. Is sending the Letter of Claim directly to their email, as effective as sending them a hard copy? I will be sending out the hard copy anyway. I'm just curious if a hard copy is mandatory.

Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
So I issued the claim on day 15 and they requested more time to respond.
They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
I opted for mediation, and it played out very similarly to other people's experiences.
In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them.
In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.
