    • no you are kidding me...   they can't be that thick surely... could be game over if they've faked it.   can you attach it to a private msg to me please.  
    • The original pdf did bring up txt boxes where my details were, it wasn't as if it was a photocopied document with my details embedded and I do find it awfully convenient it appeared the very next day after the case meeting.   The address was the same as it should have been, but ive only recently moved, this case was already in motion during my move.   Can I then just argue the authenticity of the CCA  at the next meeting? Explain that when put into a editor my personal details and only them pop up as carefully placed text boxes whereas the rest of the form looks photocopied??

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

Smart ANPR PCN - Faulty Machine - Bell Centre Melton MowbrayParking Ltd

This morning I received a letter from DR+ demanding £170. The date of parking charge was 23/10/20. The letter says they have 'traced' me to this address because letters sent by Smart to the address the DVLA hold for me, were not answered.

 

At this point I should point out I moved from Surrey to Leicestershire in 2018 and I registered a change of address with the DVLA. My driving licence is this address and though I have been unable to find it today, I am pretty sure I would have changed my address on my V5.

 

Now, I can confirm I was at the car park when they said and yes, no payment was made because despite trying several times, the one and only machine said "Cancelled. Printing error". I know because I photographed it, just in case.

 

I gather I ignore this demand but I have never had a parking problem so I would be very grateful if you could advise me of my next move please.

Well done on taking the photo - fantastic work!

 

That will be curtains for the fleecers.

 

Don't worry about DR+, they have no power to do anything.

 

I'm just concerned about Smart potentially having the wrong address, and that later down the line they could issue a court claim and win by default, as you'd know nowt about it.  How about writing a simple two-line letter to Smart quoting their silly invoice number and informing them of your new address?

Sorry both for lack of response by me. Bad week as anniversary of Mum's death. I will upload all files tomorrow. Also had a second letter from DR+ yesterday.

Send Smart a two-line letter informing them of your new address.  It will save you from the threat of a backdoor CCJ later on.

 

As for DR+, just laugh at their standard letters.
