    • Hi all. Apologies for the delay. I was writing the timeline out, taking a while as I was checking everything against emails etc… then suddenly today the parcel started tracking again and appears to be magically found and back enroute.    I’ll post up the tracking info screenshots in a sec which kinda summarises the timeline - during the multiple “Enquiry Raised” events there was a lot of emails (most of which were ignored by Evri) before they finally admitted it was lost. And yet now it is back enroute. Utterly unbelievable 🤦🏻‍♂️ So no letter before claim has been drafted just yet…
    • You can SAR them again, to check.   If: a) they dealt with it as a complaint, b) stated that their response was a final response, c) noted that you could escalate it to FOS (and had 6 months in which to do so), and d) Didn’t say “we will waive our right to have to grant permission after 6 months”  Them : you can still take it to FOS but FOS would have to obtain their permission to review it outside of the 6 months (and that seems unlikely)  https://www.financial-ombudsman.org.uk/businesses/resolving-complaint/before-get-involved#:~:text=These time limits are%3A,they had cause to complain)  
    • I just checked the last email from them that I printed out.  It was directing me to a link to files as part of a data SAR (which I never called my request; they did). The email says the link would expire in 3 months.  Now my computer crashed later in 19.  I lost a lot of info. I need to check storage for old hard-drives to see if I downloaded and saved whatever info was in the link.   I have 1 other printed out email from my friend who was a broker. It was dated apx 6w after my first email to broker.  Friend was telling me what to include in a letter to compliance dept.  I don't have a printed copy of my letter - so can't remember if was entitled formal complaint - or their reply.   Will check storage later.  If I have anything useful I will post

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can anyone please give me a phone number for the DVLA that you can actually speak to someone and you dont get cut off after countless times

 

ive been told to go onto the .gov.uk website to find out more information which doesn`t help it just winds me up even more .

 

im goin out of my mind trying to find a solution .

and why has it taken you from november till now for you to chase this?

without being rude my license ran out on the 5th January and im over 70 and the reason why its been this long is because it tells you you need to allow extra time for them to sort it due to covid. and i ve been trying for the past 2 weeks to get some answers.

why don't you simply try the online renewal process again. can't hurt to try that.

 

there are numerous reports around the net that getting through to DVLA is almost impossible since covid.

The renewel was applied for online and that was because i was aware that my license was nearing the end . i didnt recieve anything via post  ive tried ringing them countless times and all i get is a recording where  you are told to visit the website .gov.uk  and then they cut you off so you just keep goin round in circles.

according to this 

DVLA Coronavirus (COVID-19) update - GOV.UK (www.gov.uk)

 

down the page it states if your licence expired in 2020 you get an automatic 11 mth extension.

 

it also states that from jan 2021 renewals are working as normal.

as yours expired 5th jan, pers i'd assume your early renewal has been poss discarded due to workloads or not then being necessary to do so.

 

restart the renewal process again online at their website.

as far as i can see, whilst you are awaiting this to come through, unless you have any medial reason that needs assessment that could be deemed questionable to if you should be driving, you are OK to drive and are legally allowed too.

ive tried to re apply and was given a reference number but since that number isnt a 16 digit code  you cant enter it into the online form to find out the status of my licence . and you cant talk to anyone at all because ive tried every way possible.

no i dont have any medical reasons i even tried the bot chat but it seemed the cut me off and said they couldnt assist me further . so as im sure you can understand ive run out of ideas and didnt know which way to turn . but thank you ever so much for the last reply  re- the corona virus i  didnt know about the dates after december and was at a loss .

I had a similar problem - same reason.. turned 70 - For some reason, I am unable to use the online application, presumably because I need to change my photo as well.  I have got a form from the Post office and will send it via Royal Mail.  trying to speak to DVLA is a waste of time and money. 

 

As we have an 11 month extension, I am not too concerned.

Last month I did a 3 yearly 'over 70' renewal completely online, allowing them to again use my passport photo. The old licence still had two months remaining.

 

The new licence was received within 5 days, so things can work there.

My passport is well out of date, the photo probably 15 years old.. would they be able to use that ?

To renew online you need "a valid UK passport".

 

Passports run for 10 years (plus a maximum 6 month overlap period from the previous one)
