Sorry for the silence, but I didn't have the time to update. I haven't looked into this for a few weeks now. I think I will have to ring them up and find out what is happening?

I'm not sure ringing Smart is necessarily a good idea but please wait for others to comment.

Rereading the thread, the advice was to send a holding letter to CST Law and a SAR to Smart, on 4 January.  Did you do this?

 

And have Smart replied?

I'd sent the SAR, but not the holding letter. Nothing from SMART, yet. But then, I have ,moved in the meantime!

then you need resend your snotty letter again in reply to the new PAPLOC from your new address and quick.

At the moment you have no idea whether you owe the money or not.

You cannot remember even being in that car park so why are you even considering paying?

 

It may well be that  Smart have misread your reg. number and if so they owe you a much larger sum than their spurious charge of £175 for a breach of GDPR.

 

Another alternative is that the car in their photo was using cloned plates. 

Also Smart didn't recognise their own PCN reference so why are you in a hurry to pay what is probably someone else's PCN.

 

Could you please post up the new PAPLOC so we can if there are any changes from the first one.

Also I would write [a letter not an email] to Smart saying that you have no knowledge of the PCN and in view of  an impending court case, it is most unfair that you have not received the paperwork. Perhaps you should include your reg. no. as the poor dears seem not to be able to reconcile PCNs.

 

That letter is the start  of  a paper trail that builds up what an inefficient bunch are pursuing you should they later decide to take matters further.

We're not miracle workers.  You've given us next to nothing to work on here.

 

You're being threatened with court for something, but we don't know what because you've thrown the original paperwork away despite being in legal dispute.  So we say to SAR the PPC, but then you move without saying anything so presumably the SAR could be sitting there at your old address.

 

We say to send something to keep CST Law at bay and you don't do it.

 

If you don't get your act together it's perfectly possible that Smart will sue you at your old address and win by default.

 

To get out of this mess you need to send a snotty letter to both CST Law and Smart tomorrow, by 1st class post, which also informs them of the change of address.  The snotty letter will have to include lots of guesswork as unfortunately you haven't got any paperwork.  So do a search for "snotty letter" here and post up what you propose to send and we'll retweak it if necessary this evening.
