VCS vanishing Windscreen PCN +NTK - walked off site - Brook Retail Car Park, Ruislip, HA40LN

Hope someone can help me.

 

I parked my car in Brook Retail Car Park, Ruislip, HA40LN on 10th December for less than 90 mts (their max allowed time is 90 mts).

I didnt find any windscreen PCN on my car

 

I have received a letter today dated 17th December 2020 asking me to pay the fine.

The reason is Parked in Restricted / Prohibited area.

 

I definitely parked in a bay and I can also see a car next to mine in the picture.

Futher, in one of their photos, I see a windscreen PCN but i didnt find it when i took the car.

I would like to appeal and any guidance would be appreciated.

 

PS: I have attached pdf scan (front and back of PCN) and pdf of picture with windscreen PCN which I couldnt find when i came to the car.

2 Have you yet appealed to the parking company yet? [Y/N?]

if you have then please post up whatever you sent and how you sent it and the date you sent it,

Don't appeal.  We know VCS very well, they are one of the most crooked of the PPCs, run by a complete charlatan called Simon Renshaw-Smith.  They never, ever accept appeals, and by appealing you could throw away legal protections under the POFA 2012 law.

We could do with some help from you.

Yes. I read this post. 

 

signs will be the key here. --> I definitely remember parking between 2 white lines and one side is visible in one of the pics (which I have attached)

 

Any advice on appeal?

you don't appeal

they can't issue a windscreen ticket and then send the NTK within 29 days anyway

Yes. Don't appeal, as the guys have said. Have a read of other VCS threads to get an understanding of how they operate.

 

Are you aware that most private parking companies used to be clampers until the government stopped them? That gives you an idea of who you're dealing with.

There are several reasons for not appealing.  To start with, it's a waste of time, the PPCs never accept appeals, certainly not Simple Simon.  We have a case at the moment where Simon is demanding money from a driver for stopping in a "no stopping area" at an, er, zebra crossing, with an, er, pedestrian walking in front of the car.  I kid you not!  That's the type of vermin you're dealing with.

 

Motorists are sometimes demoralised when the appeal is inevitably refused.

 

Respecting the PPCs' procedures just encourages them to pursue you thinking you'll cough up.

 

But most importantly of all, at the moment VCS know from the DVLA who the keeper of the car is, but they don't know who was driving.  Lots of people drive other people's cars, my son often drives mine.  There is a law, the POFA 2012, which allows them to transfer liability from driver to keeper, but only if they respect the law, which they already haven't done in your case by sending the NTK too early.  When motorists appeal they inevitably write "When I parked" and out themselves as the driver.  We have a new thread next to yours by a driver who parked in a Basingstoke car park who appealed and mentioned he/she was the driver.

 

As far as we know you parked properly in a bay and so you owe Simon nothing.

 

Is the car park near to you?  If so it would be useful to go back, get photos of the signage and also the area you parked in.

Yes take photos of the signs at the entrance as you go in from the road and any dotted about, and note where they are also a close up of the wording on both the signs at te entrance and the ones on the site. then post them up as pdf please.

Walking away from the site is not a reason to charge you anything, PPCs lose on that as is unfair term.

the old reverse trespass law..no such thing.

 

and if you check on the relevant councils website planning portal, they would never have granted such a short parking period nor allowed it to be varied by anyone bar themselves.
