    • I posted on here previously about a Lloyds debt that was sold to Lowell and they sent a claim from for the debt back in 2018. We went through mediation, they didn't have any evidence at the time and I was told it would go to court.    Link to old thread -    Needless to say nothing was ever heard from for years and I forgot all about it.    Today, I received a General Form of Judgement or Order. It read as follows   Before Deputy District Judge Wiggins...   It is Ordered that 1. Documents Filed 39 November 2018 must be served on the Defendant and a certificate of service filed.   Pursuant to CPR Rule 3.3/Rule 23.8 of the CPR 1998,  then the standard if you object to this order.   I have no idea what has happened, what has gone on and I have received nothing since the mediation in October 2018.
    • absolutely. I still remember that advice of yours and have a monthly reminder on my phone to watch out for any comms. also remember that I have to have write to them if I ever change my address.
    • Very well done and thanks for letting us know. Very much appreciated. This kind of knowledge is very helpful to lots of people who come here
    • mrabody   You're spot on mate.   Barclays aknowledge my complaint.   I’m sorry you’ve had to contact us again regarding your complaint and that I’ve been unable to speak with you directly when you’ve called.   I can assure you I’ve reviewed the information you’ve sent and I’m currently liaising with the relevant team to try to get this resolved, as soon as possible. I’m afraid I can’t give you any more information at the moment, nor can I give a specific timescale as to when I’ll be able to get an answer for you. However, I will provide you with an update no later than 26 January 2021.   Thank you for your patience in the meantime.   Kind regards

    • Hi @BankFodder
Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
So I issued the claim on day 15 and they requested more time to respond.
They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
I opted for mediation, and it played out very similarly to other people's experiences.
In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them.
In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.
Many thanks, stay safe and have a good Christmas!

trying to trace a NFC (National Freight Consortium) pension

Recommended Posts

I am trying to trace an NFC pension dating back to 1978-1988.

i have tried various tracing sites inc the Govt one, but to no avail.

I think the fund was taken over in 2000 by Exel logistics, but not sure.

Any former employees out there, or other experts who could help?

Hello and welcome to CAG.

I've spoken to someone who deals with old-style pension schemes and from that conversation, I'm afraid I think you probably don't need a pensions expert and may need to be your own Sherlock Holmes and track where the Exel pension fund went to or which company they were bought by if there's nothing on the government website.

Did you have a leaving service statement about your pension when you moved on from NFC and did you keep them advised of your contact details?

For what it's worth, someone posted about their Pickfords pension benefits a few years ago and they traced them.
