Dear Respected members,

 

I came to know have a CCJ against my name and CCJ was by default on November 2016, I contracted to court and found that solicitors known as Cohen acted on the behalf LOWELL, i contacted to Lowell and asked all the file which they hold against my name and also requested to send me a copy of original agreement as they claimed that original creditor was Argos and account was open with them in 2013. 

 

In 2013, I was not in the UK and explained to them, anyway cut the story today I received my file what they hold in that couldn't found original agreement as they claimed.

 

Kindly if someone can help me what the next action should be taken?

doesn't matter if they hold no paperwork

the Judgement CCJ sadly trumps that need.

 

the fact you were abroad at the time of the judgement might be a reason to set aside the judgement BUT:

1, if you didn't inform your creditors of that, it's a tough fight.

2> you'd also need a basic defence for the actual particulars of the claim.

 

when did you take the argos card out?

when did you last pay or use the card?

As I mentioned i am not aware about argos card, and lowell informed me that account was open with argos and 2013 annd sold to them in 2014 and last payment was made 5 pound in july 2014.

then not statute barred either.

 

did you move around alot, could it possibly be fraud and someone used your details in 2013?

 

not that that will help much either unless you can prove where and when it was signed up for and you were elsewhere?

As was living on rented accommodation but that property was belong to one of family member therefore didn't bother to change the address. No idea where to start as CCJ is there.

so you know the address it was taken out at and you can PROVE you were not living there at the time?

the CCJ will remain on your file for 6yrs from it's date

have you proof in writing by some method that you were living elsewhere ctax bill rental agreement , not a letter from joe bloggs ...down the road.

 

you are going to have a very hard job in setting aside this CCJ unless you can prove fraud/identity theft.

Yes I can provide the concial tax letter, and also to get original agreement should i request to lowell or arogs or both. 

 

Should i contact to court and asked the full details claimant claim bundle?

it was a backdoor CCJ, there would have been no documents or bundle or anything that a human ever saw or asked for

it's what we call a roboclaim, no human is involved.

 

you could ring northants bulk and ask for a copy of the claimform and the judgement CCJ - by Email pdf

they most probably wont have a copy of the claimform but you need the exact text of the particulars of claim

record you call they might have it onscreen and can read it

you also need the exact address it was served too by mail.

 

i would suggest that this was an online signup so no real good in asking for a copy of it from argos but you could try a free SAR

stipulating that you ALSO wish a copy of the agreement as you suspect ID theft, they might have it but its more than 6yrs ago so might not.

 

at this stage you are in the info gathering part.

another month wont hurt you to wait.
