Hi all.

I'm trying to help my husband claim back charges for an old RBS Student account that is now closed. I sent the SAR and they quickly sent me the duplicate statments going back to 2000. I checked through and highlighted all applicable charges.

I sent the prelim for £342, fobbed off so sent the LBA which gave them until 7th Nov. No response so husband phoned and they strangely agreed to post a cheque for £342. Result, or so we thought.

Tonight, I have just re looked at the statements because the cheque hasn't arrived so I was going to use MCOL to start the claim. However, I seem to have been caught off guard. I found a yellow agreement, which has the same numbers as the actual student account, but it is a credit agreement. It says:

3) The Credit £1,000.

4) Interest £240.76.

5) Administration Fee £25

6) The total charge for credit £265.76

7) The total amount payable £1265.76


24 repayments of £52.74. (APR 26.5%).


This has baffled me. Now was this a loan agreement, or was it a loan to pay the balance of the card. It is not dated so I am unsure if it was taken at the same time as the card was taken and there are no signatures on it. On the actual bank statements that I was sent, it just looked like what I thought was an interest free student account which has a limit of £1000, but now I don't know how the 2 are linked.

On my prelim and LBA I have made no reference to interest because it isn't on any of the statemtns, but there is an interest figure on this other yellow sheet. I'm really stuck. Any one else have a student account that could shed some light on this for me. If I am entitled to claim interest at 25.6% that will make a huge difference to the claim and would also explain them agreeing to refund £342.

MBNA £1230. For Hubby.

RBS £342. For Hubby.

Cap One £200.


:D Settled in FULL April 18th 2007. £5179.83 Paid but what a long battle!
