Hi I opened a capital one card in 2002 and I ran in to difficulties in March this year.

 

i contacted national debt line and worked out a payment plan of £8 per month.

 

the balance is £3500

 

capital one subsequently defaulted my card.

 

today I started getting texts and calls from Lowell and tonight when I got home I received a letter from them stating they had now bought the debt from capital one and I needed t- contact them to work out a payment plan.

 

please can I have advice please.

 

is this debt enforceable?

 

What should I be doing?

I would send Lowell the following for starters.....do not ring them or text or email.Keep all correspondence safely filed.

Cap one no longer own the debt its been assigned (sold ) to Lowell.....you need to do a bit more reading Andrew.:biggrin:

 

Secured or none secured.....both easily enforced.

Upstate.

 

I received a letter from Lowell today saying they have acknowledge my request for CCA.

 

I sent this over a month ago.

 

they say they are asking Cap one for the information and they aim to provide it within 12 working days.

They go on to say they are not posting any information out by Royal Mail at the moment and I must send them my email details.

If I do not provide these they will not send me anything out until COVID government restrictions are lifted.

 

I am not keen providing them with my email as I don’t want to be bombarded with email.


Any advice would be appreciated

There are no Government restriction on postal services...it means all their staff are probably furloughed and there are no staff to respond or gather copies of agreements.......they are sending this out to all CCA requests....simply aimed at gathering your personal details Email address...your not in a rush let them take as long as they wish...there in default.
