Hello all,

 

Hoping for some advice,

 

I was a member of Gymbox who cancelled my membership when the branch I had a membership for failed to reopen back in July (the particular branch is still closed now). 

 

I submitted a cancellation notice (30 days notice required) and this was confirmed to me in writing. As the gym was not open during this notice period I cancelled my DirectDebit - I didn't think it fair to pay for a Gym I could not use.

 

GymBox subsequently called me to ask me to pay and informed me I could have used another branch of the Gym during the 30 day notice period (this was not allowed in my original agreement, nor was it communicated to me when my cancellation was confirmed). I disputed this in writing in two emails which went unanswered.

 

GymBox has now referred me to ARC Europe who have started to contact me in relation to the contested debt.

 

What is my best course of action here?

did you allow one more DD payment after submitting your cancellation letter?

or

are you saying you cancelled your DD months before then latterly writing to cancel your membership?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Well Gymbox have got a damn cheek and if ARC agreed to chase this on their behalf, then they have a damn cheek as well.

You are right to cancel the direct debit. Don't worry about it but come back here if you hear anything from anyone.

Site team colleague @slick132 will probably come along to confirm.

write ONE letter to the gym by royal mail or deliver by hand..

 

Dear sir or madam,

 

I refer to my xxxx membership at [town/city] which I had to cancel due to  I didn't think it fair to pay for a Gym I could not use. in the current health crisis.

 

I now realise I should have paid 1 final month's gym fee after giving notice to cancel and offer to pay this gym fee now. I will not pay the unlawful admin fee which you say is also due.

 

Please confirm in writing that you will accept the £xx gym fee to settle this matter and supply your payment details and a payments reference number.

 

If you demand any higher amount, or fail to accept my offer within 14 days, the offer will be withdrawn.

 

Yours faithfully,

Yup, do what DX suggests but send the letter to the gym by posted letter and get a Certificate of Posting at the PO to keep as proof of posting.

 

Ignore demands from ARC for now but keep us posted ...........
