Hi...Received letter from courts stating Barclays have been sent my claim and that they now have until 13th December to acknowledge. They'll probably leave it until last minute then have 28 days to actually 'defend'.

28 Oct...Sent LBA

10 Nov...Rejected £700 full/final settlement

23 Nov...filed MCOL

27 Nov...Barclays have until 13th Dec to respond.

12 Dec...Barclays acknowledge claim.

16 Jan...Case transferred to local court 16th is AQ deadline!

Case transferred to local magistrates and I've been sent the AQ...filled in and sending off by 16th Jan deadline! Hopefully not be too long a wait on the cases being seen!

Case transferred to local magistrates and I've been sent the AQ...filled in and sending off by 16th Jan deadline! Hopefully not be too long a wait on the cases being seen!

I've received your PM. Will do some checking and get back to you. But please have a look at the following:

 

If you take a look at my thread, you will see in page 9 post #173 that I have listed the dates as certain stages were reached.

 

It would be handy if you list as many of these as you can for me (PM preferred) and especially, I'd like to know the dates any offer letters were received, amount you were claiming, the amount they offered you and the timescale they gave you to respond to that offer.

 

Please do this as soon as you can.

 

I will also send you a few questions by PM after you send me the information I need. Once this is then remedied, we can post the details here on your thread.

what did you put in section G ,any other information etc.

 

Yeah do something on the lines of this as you need to ask the court to order standard disclosure...something the banks shouldn't want to do...

 

Section G you need to add something along the lines of this, which asks for the Court to direct the Bank to disclose its costs re breaches of contract: "I am respectfully requesting my claim be heard via the small claims

track. This issue is not a complicated one; it is an issue of fact and

not of law. The issue is only whether the money levied by the

defendant in respect of its customer’s contractual breaches exceed

or even reflect their actual costs incurred. I am happy to pay their

actual costs and I am surprised the defendant did not counterclaim

for these, as I would have paid them without argument. However,

the continuing problem is (in common with the hundreds of other

cases currently being brought by other bank customers) that the

banks are refusing to reveal the details of their penalty-charging

regime, and that the charges they apply to accounts for exceeding

overdraft limits and so on are entirely disproportionate to the

actual costs the banks incur. As the banks have a fiduciary duty

towards their customers, they have a duty to deal straightforwardly

and in utmost good faith. Accordingly, I would respectfully ask that

the court in this case, not withstanding allocations to the small

claims track, order standard disclosure. I understand that it is in

the courts discretion to do so. I believe this would bring a rapid

end to this litigation. I have attached the schedule of the charges

I am claiming for to this allocation questionnaire to show a

breakdown of the amounts for the courts perusal.

I believe the case will take no longer than 1 hour".

You'll have to write it in quite small handwriting as it only just fits in the space provided.
