There was a technical fault with the Moneyclaim.gov.uk website yesterday so I couldn’t register my claim. I have emailed the help desk just waiting for them to get back to me.

I think it may take some time - they first have to make a decision as to whether you have a case I believe. I would continue with your moneyclaim filing and write to the Ombudsman after. Just my opinion, but there is no point putting it off, in case the Ombudsman aren't interested. Plus they are probably dealing with hundreds of complaints at the moment!

Status:

 

Halifax - DPA sent 03/03/06.

Prelim Letter - Sent 27/03/06 ignored.

LBA sent 10/04/06 - Ignored

Moneyclaim filed - 26.04.06

Acknowledgement received 3rd May. Halifax state they intend to defend.

Halifax Settled in Full - 17 May 2006

Hey Rat.. (I guess my signature sounds a real resonance with you eh?!)

 

Sound like u r progressing quite nicely.. would perhaps slow down a tad with the FOS...

 

FOS are only there to investigate claims by individuals who feel that a Bank or financial Services Provided have neglected to resolve a complaint to their satisfaction and thus are in breach of the Financial and Services Marketing Act 200, or the Banking Code and other statutes/FSA regulations.

 

FOS is actually an independent offshoot of the FSA (the regulator). Given that the FSA sets out the guidelines under which financial service providers should attempt to resolve a compaint (in particular time frames - 4 weeks for first response, 8 weeks to resolve the complaint) then you will prob find FOS will not even consider investigating a case until the 8 weeks are over - this is standard practice.

 

You have to allow the institution the chance to resolve the complaint. As yet,Barclays are not in breach of any FSA regulations or the Banking Code with regards your claim. And the FOS are there as the investigatory/reconcillatory arm of the FSA.

 

Im just saying don't running up the drainpipe just yet... you won't need to anyway.. cos i think you are gonna win this particular race... Rat.

BARCLAYS settled in full 2 days prior to submission of defence by Barclays

8. Notice of issue received from Northampton County Court 28th April

 

Your claim was issued on 27th April

The court sent it to the defendant on the (same day) and will be deemed to be served (5 days later). The defendant has (14 days) to reply.

 

If they file an acknowledgment of service. They have 28 days to file a defence or contest the courts decision.
