Hello

The letter you need is here

http://www.consumeractiongroup.co.uk/forum/bank-templates-library/92-3-letter-before-action.html

You need to spend time reading the FAQ's and Step by Step instructions, the answers to this and most other questions are in there.

iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.

Vanquis - Claim issued, no AoS or Defence received

Hi

Initially they will probably file and Acknowledgement of Service and indicate their intention to defend. However, Lloyds have been showing signs of paying out a little earlier of late - that is not to say that they will in your case, but many others have found that they have been doing this.

Once they file an Acknowledgement, they get a further 14 days from the date of service to file a defence.

Once that happens, if you are at all unsure of what to do, come back here and ask.

Hi Barcaboy

Not much you can do, just wait for your allocation questionnaire to drop on your door mat and return it within the deadline.

Hi an Allocation Questionnaire is a request from court for more information allbeit very simple if going through Small Claims. However I suggest that you start a thread in the Lloyds forum and keep us informed there, also have another read thru all the self help material as this will answer many questions. As will having a read around the Lloyds forum and Lloyds successes. :)

I have not received anything from court or any letter from Lloyds.

Last letter was from court saying Lloyds intend to defend the whole claim which gave them upto th 4th January 2007 including the extra 14 days.

Should i have heard from court

Hi Barcaboy.

Well the 4th Jan. was Thursday. That means that any communication would not be processed until Friday. Just how good do you think the postal services are? :D

Give it a couple of days, and if you still haven't heard anything, give the courts a ring and quote the case reference number.

Just had lloyds defence letter that they sent to the court which basically states there banking code with regards to account.

Now what do i need to do in response.

Or should i expect something else to follow through court and i am a bit worried that they have sent in a defence,

Is this the norm

Hi

This is perfectly standard, so no worries there. You will get an Allocation Questionnaire to fill in next, fill it in, send a copy to SC&M, here are a couple of links to help you with it:

http://www.consumeractiongroup.co.uk/forum/general/57708-draft-order-allocation-questionnaires.html

http://www.consumeractiongroup.co.uk/forum/bank-templates-library/11644-allocation-questionnaires-guide-completion.html

I would also suggest having a good read round on here, so you know what to expect.

Good luck!

Barty:)

I have got to the stage now for the AQ,

But am affraid I am getting out of my depth,

is there any new template for this or can anyone advise the best way to fill this in as i want to be ready.

The defence letter from Lloyds is basically telling me there there banking code and that i knew all about these charges when opening an account,

Is this the standard response everyone else get,

Please help as i do not wish to fail by returning forms under filled with not enough info on,
