This may sound dumb but just wondered what it means when your claim changes to acknowledged status on MCOL. I started my claim on 16 November 2006 and it has come up as acknowledged 29 November 2006???

 

Can anyone help?

Hi, Lig

It means that the bank has acknowledged receipt and service of the claim. They have 14 days from the deemed date of service to do so. Having done so, they ahve another 14 days to file their defence. Expect them to take all of it and perhaps even a little more. NAtWest seems to be the worst of the lot in stretching things out.

Ok call me stupid but does that mean they have 14 days to put in a defence from the 29th as that is the day they are deemed as served??? How comes it takes 14 days for a claim to get to them??? This is madness!!!

The defendant has 5 days to receive the claim (this is the deemed served date), then they get 14 days to aknowledge. If they acknowledge, which they have, they then get a further 14 days to defend.

So in simple terms, their deadline for filing their defence is 33 days from the date you filed your claim - 16th Nov.

 

Deadline for defence is 19th Dec!!

Thanks Deller - that is very helpful. What happens if I hear nothing by the 19th to I file for Judgement?

 

I have not received on response from them throughout this whole process which is quite irritating really!!!

Yes you will be able to file judgement, but its usually better to allow a couple of days after their deadline because if they file their defence right at the last minute they can apply for a set aside, this will delay proceedings.

Its not unusual for them to not reply, just remember they're probably swamped with claims at the moment!! LOL

I guess you are right it just makes me a little uneasy like my claim isn't valid or something - I guess I am just paranoid. I really could do with some cash for Christmas but I suppose that would be wishful thinking lets hope they are maybe feeling merry and just want to settle in full without all their delaying tactics.

Skipped the S.A.R stage as I had over six years worth of statements, sent my preliminary letter on 1st Sept. Cobbetts deadline for returning their AQ is today......so hopefully not too much longer!!

I kept all my statements as well which was lucky as this part appears to be a nightmare for everyone.

 

Well I willl keep my fingers crossed for you. If they don't submit their AQ do you win by default?

Yeah, it will be interesting to see if they miss any deadlines with Christmas coming up!!!

 

Obviously the Courts need to close for Christmas and the post if a lot slower - will this make any difference to our claims?

Don't worry this is totally normal. Nat West are the worst for stringing things out to the last minute. I think we worked out that their deadline for submitting a defence was 19th Dec so hold fire til then and you can be sure they'll get it in by the skin of their teeth.

 

With regards to offers, some people get one just before receiving the defence, and others just after, so you never know there may be some sort of offer on its way soon.

Thanks Deller - helpful as ever. I am just worried that due to the posting dates over Christmas this thing could all get messed up!!! Never mind just have to wait and see.

 

Flaming - check out the thread above it works out once your claim is submitted the final date is about 33 days after that.

The dates for your claim should be fine Lig as the deadline is 19th so therefore falls before the Xmas period, once the defence has been submitted the next stage will be the AQ's. The court will issue the deadlines for the return of these so don't go panicing about missing dates. ;)

Phoned the county court a coulpe of days ago to check the progress of my claim as I had'nt heard anything since the AQ deadline (30th Nov), they advised me that the defence had been struck out and that Nat West have until 4pm on 3rd Jan to submit a new one. Hopefully with Xmas upon us they'll find it hard to match this deadline and I'll be able to enter judgement.
