    • Hello,   I have read the thread on the other board and, sorry to say, agree with the answers.  However, I only know HR, and not specialist commercial  law.   I would see it as a breach of our agreement and seek to make you stop/ repay any funds we had given in settlement. I have certainly done that before, and been successful. The general "we will not speak ill of each other" type of clause needs to go both ways. You would not be keen if they posted on message boards saying you were uncooperative/ awkward etc, even though in their eyes this would be true.   I think you really will need to pay for a specialist lawyer if you are determined to find a way to keep the money, and keep complaining.
    • Yes you will have a claim – but it will make it much easier if Marquis are on notice. You should write to them very urgently and tell them what has been found and that because of the fact that they have denied that any work needed to be done, you have now put it in hand elsewhere and you will be looking to them to reimburse you. It's essential that they are kept abreast of developments every step of the way – in so far as possible – in advance
    • Hi Guys, sorry I am late.   I hope under LIP I can get this in today, was due last Thursday 4pm, 2 working days late, should be OK I hope   I just couldn't face it Friday, too overwhelmed by the legalease and what to do then developed flu/cold with heavy covid cough over weekend and didn't feel up to it BUT been on it for last 90 mins and got right into the zone and found a couple of other cock ups by Lowells!   Both agreements have the WRONG acct number on, couldnt believe i missed it!   I led with my defence and then have tried aligning my against theirs with my own headings, b1, b2, c1 in case you want to refer to any point or mistakes     Please can someone take a look please and check its passable   TIA Sew Witness SB.pdf
    • It most likely will be a phone or online during the Coronavirus crisis. If your WS has trashed his robo POC, and he thinks he will lose he might bail and discontinue.
    • Marquis were already given a chance to repair and returned it to me saying nothing was wrong with it but they hadn't done any investigations. So do I no longer have a claim? The assessment by the manufacturers is being done and they may or may not be repairing it at the same time. Thanks

      I bought some clothes online in may through Evans and paid through PayPal
      returned them all seven days later
       
      I waited the 14days for my refund and no refund came
      I put in a dispute through PayPal but I didn’t get any emails to escalate the case - PayPal closed it. 
      evans said they couldn’t refund the money because PayPal have cancelled the refund because of the open dispute
       
      I contacted PayPal
      they said the dispute had been closed but Evans at no point had attempted a refund.
      fast forward to today
       
      I’ve got copies of numerous messages sent to and from twitter messages as it’s the only way I can contact them
      I’ve also contacted their customer service too
      all I get is PayPal have cancelled refund because dispute is still open.
       
      I have proved that the dispute is closed
      I have got an email saying that if Evans sent the refund they would accept it
      but up until the date I got the email they have not once attempted a refund .
       
       I have sent them a letter before court email
      I have even offered to have the full refund as a gift card just to get this sorted !
       
      I’m literally at the end of my tether and don’t know where to turn next !
       
      i suffer with mental health issues and this is affecting my health and I’d saved the money for a year to buy these clothes as I’m on a low income .

Self employed Mortgage protection /unemployment/sickness Policy

Good Morning,

 

I put in a claim on lockdown was declined (unemployment)

I appealed to FOS who upheld my complaint this week 

 

For the first three months had payment holiday for mortgage, next three months  borrowed money to pay half the mortgage,

 

Ive recieved email for the insurance that they are reviewing.

 

Would it be unfair for me to ask for full 3 months payments and 3 half payments + compensation due to the fact they declined my claim. To make ends meet my wife continued to work even though she was high risk with me home caring for our child. Pretty much a worrying and stressful time.

 

Or wait for review and if not happy then approach FOS representative who has been dealing with this ?

Your entitlement should be stated in your policy documents and that is what they should pay you.

 

If you are looking for compensatory amounts (outside of policy cover) due to previous declination, then you should make some calculations of what loss you have suffered as a consequence.  Then send a letter fully explaining why you are seeking compensatory payment in addition to what is due under policy terms. If you provide reasonable justification for the amount, then hopefully it should be considered.
