Hi all,

 

I'm writing on behalf of another person who just read this. I've made an account to post up a very relevant question.

They have a ticket from exact same car park for £60, turning into £100, for not buying a ticket...

 

They had no idea you even had to buy a ticket, but that is besides the point. 

 

Here are the facts about what has happened and actions taken:

 

-the ticket is addressed to the wrong person - a certain person was driving the car but they've addressed the ticket to a different person, the car owner.

 

-the certain person driving the car has a screenshot from online banking of £10+ pounds being spent in Morrisons

-the certain person does not have any kind of receipt for the ticket that was bought for the car [which either was lost, wasn't bought properly or didn't exist in the first place :) ], but DOES have the evidence of spending at Morrisons which I think might give the person free reign in the car park

 

-the owner of the car sent the ticket to the certain person driving the car, who made an appeal with his/her name as the name provided (even though the ticket is to the car owner) with a completely random explanation about how money was spent at Morrisons. This complaint was naively sent before doing the proper research and finding this incredible website.

 

So, what action should be taken?

-As i understand it from this thread, they have broken some kind of GDPR in getting the details of the car owner.

-They have the wrong person on the ticket

-There is evidence of £10+ being spent at Morrisons on that day at that exact time, which could be leveraged!

 

As a first appeal has already been sent, does anyone have any good advice on what second appeal to launch (once the first one comes back to the certain person, i'm assuming)?

The fact CEL sent the invoice to the keeper rather than the driver is just standard practise.  They get the keeper's details from the DVLA. 

 

It does mean that generally CEL don't know who was driving on the day and therefore don't know who to pursue legally, which is why we advise not to appeal.  Your mate has made a mistake by handing over this info. to CEL, although certainly not a fatal mistake.

 

The first thing to do is to get on to Morrison's.  We've seen in the other thread that the local branch are a waste of space so don't mess about - straight on to the CEO.  Point out that you were a genuine customer, show the screenshot showing payment and demand they cancel the ticket.  You'll have a better chance than yewneik in succeeding as you'll be moving quickly and yewneik involved POPLA which will have cost CEL money.

the owner of the car is immaterial in all parking ticket issues...

 

it's the registered keeper that they get the details of, from the DVLA, once the car number plate is captured by their ANPR system and a relevant payment is not matched to the reg no. or the retail store system does not cancel it, is the one that gets the PCN.

 

you say the driver appealed, so thus he must have given them his details, good the RK is now out the picture.

appeal to morrisions

ignore CEL and their DCA's

until/unless the driver gets a letter of claim.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
