What a bunch of muppets HSBC are ! Had a letter responding to the initial request from a "Senior Product Mngr" making the following points; (& please don't laugh too loud when you read these!)

1.If you wish to proceed, please supply the detailed breakdown etc etc

2.In your breakdown of charges you refer to "total charges" (hang on haven't you just asked me for that same beakdown?)

3. If you want us to provide the information we can do so for a small fee. (mmm, someone hasnt reviewed the file, and seen that they've already done this)

 

Also the letter was sent & marked "without prejudice". So I've responded, giving them an additional 7 days to settle before I issue a MCOL, also sent copies of list of charges, LBA, & their response to the SAR. Also highlighted that if I am missing information, then the 40 days are more than up & I can report them to the Information Commissioner etc. I've suggested that they may wish to avoid legal costs & interest, and asked that they provide me with a breakdown of their costs in issueing the charges. Let's see what next week brings.

Phone call from same "product mngr" asking what sort of deal we'd be prepared to accept, were we looking for 50% or 90% (note at no stage did he offer 100%!). We asked for 100%, this week, (to avoid their legel costs & interest), or we'd start preceedings. His response....see you in Court then !!

OK we said, and asked him to confirm that view in writing....still waiting for the letter !

that's the trouble with phone calls - they can deny them!!!

get your paperwork ready to file your claim- dont wait for the bank to respond becuase they probably won't! just stick to your original timetable and if they havent come back to you with a satisfactory offer - go for it.

Letter duly arrived with offer of £800+, about 70%, and denying that what we're claiming for were all charges, but also apologising for the SAR not having been completed properly (the summary sheets were missing).

Anyway, fax sent off to same chap, giving him another week to reconsider paying the balance, then if not MCOL next weekend. They can't turn round and say I haven't tried to negotiate, as this is twice I've highlighted that they would be liable for costs + interest when they lose, and they will have had every opportunity to cough up.

I'm trying to sort out my business too. I've put in all the charges for the account, knowing that some are for cheques paid in/out, DD etc. I tried excluding all monthly charges of around £10 as this seemed 'reasonable' for running the account and still ended up with well over £1000 but didn't want to guesstimate per se in case that prejudiced the case if it came to court.

 

Then, today, I received a statement with £68.25 charges on it. I phoned HSBC Business and asked what the charges were for.

 

£1.25 activity charge

£3.00 account fee and

£64.00 for the 16 occasions I was overdrawn (£4 each time)

 

This doesn't make sense as once the account goes overdrawn, it's overdrawn pretty much at the moment as I have been forced to close the business and cease operating because the bank account seems to cost more than I can make.

 

I can't see this £4 charge being per day as the account was overdrawn for 27 days in that month, not 16. The only thing I can see it relating to is that there were 8 D's in that monthly statement as there were very few transactions during Dec/Jan. So, every time they type a D in my statement I get charged £4 for being overdrawn and £4 because they put a D next to the balance instead of a C???!

 

However, the account has been overdrawn for entire months at a time and I was never charged £4 = 30(or 31) so perhaps, I thought, there is a specific number of days in a month that you can be charged for? However, during December I was charged £80, and the account was overdrawn all month. Confused?!

 

Have you ANY idea how the £4 fee is charged? Also, how do you work out what has been charged according to the small business tariff and what is 'unlawful' penalties??? All thoughts welcome, as I'm fed up with being driven into an overdraft for a business that after 10 reasonably successful years has now had to close.

 

I phoned up to close the account (I have to write to my branch), but now of course in order to do so, I owe them at least 16 days of £4 because the Dec/Jan charges took me overdrawn.

Hi Skint, Haven't got a clue on the £4's I'm afraid, I just went through the statements with a highlighter & marked all charges for bounced dd's etc.
