    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I would appreciate advice please.

My office relocated in July due to downsizing and I was given a parking permit (secondhand) to park in the road.

I promptly sent a copy of the amended permit to my HR department for them to notify the parking company,

displayed the permit on my car at all times, and forgot about it ...

I received a PCN for an infringement 10 days ago.

My work have told me to appeal before they will agree to pay it. In good faith,

I had expected my HR department to transfer the permit to my vehicle.

HR have not yet investigated as to why this was not transferred as the person is on annual leave currently.

Possibly my email could have been caught in junk mail as there was an attachment with a picture from my mobile phone.

I failed to ask for proof of the transfer to my vehicle, which in hindsight I should have.

I have not yet appealed as advised in the topic by silverfox1961.

I have also noted that I should not give them my email address.

Do I have grounds for an appeal?

Thank you for any assistance.

who owns the land?

your works contract with permission to park there far exceeds any speculative invoice.

i notice these are operator pictures so a PCN should have been affixed to the car

not sneaky pictures thru trees.

do NPE patrol the area?

or is this a local who takes pictures and dobs people into NPE for a backhander?

please don't hit Quote...just type we know what we said earlier..

  • dx100uk changed the title to NPE PCN - NO permit in my name - works parking - Lonsdale Gardens and Clanricarde Road, Tunbridge Wells, TN1 1NU Parking Ticket - Do I have grounds for appeal?

At old building, we had to move three cars off work driveway to allow ambulance to take work colleague to a&e. NPE Parking operator pounced and was about to slap tickets on moved cars.

No, no notice stuck on my vehicle. The roads have private parking enforcement.

well they can't have it bothways. is this a anpr capture or a windscreen PCN

those are clearly NOT ANPR capture pictures

they are from, as you say, a mobile patrol operator.

that means, if you read the link you posted to fill out the details questionnaire, they should not have issued a PCN through the post within 14 days

but a Notice to Keeper issued between 29-56 days

so as usual NPE have screwed up already

They have shot themselves in the foot, If you haven't appealed, dont do,  they would be very silly if they carried on with this, but PPC's are greedy and not honest brokers. Those sign pics would be very useful.

We could do with some help from you.

The private land is actually two parallel roads with another at right angles.  The properties are a mix of residential and businesses.

There are two ANPR cameras and it is quite possible that the one on the corner overlooked my car.  However, an operator would have had to take a close up picture of the number plate as there was a car directly behind mine.  I had a permit on display on my windscreen and the number plate changed in ink from the previous employee's to mine

Was there a photo of your car taken from the front showing the permit on show?

Which photo is the one that is at the entrance to the parking area please?

I don't see the address of NPE on any of the signs.

NPE were brought to book some time ago for calling themselves NPE Ltd on their signs since a company is already registered as NPE Ltd. Shame they have amended it on your area-it would have been one more black mark against them.
