This site has got me really confused... a friend was helping me out but now I dont know what to do next!! The last thing we did was send a letter off to Halifax with how much they have had off me. They sen tone back basically saying tough... where do I go from here?? :confused: :confused: :confused:

Sounds like you sent the prelim. Read the FAQ's and if your happy that you've done everything in order so far, send the LBA. It's all in the library, but I can't stress enough to read the FAQ's and the step by step guides. Better to delay a few days whilst you do your homework than stuff it up later for court.

You need to advise them you'll be pursuing your claim - send the Letter before Action with the spreadsheet of the details if you haven't already. There's a template in the FAQ section. If you've done that (not clear from your post) this is what will happen:

 

They'll write back and offer you part of what you're owed, then you can do one of two things (don't accept it unless you are really, really strapped!):

  • write back, tell them 'thanks very much I'll accept that as PART PAYEMENT ONLY' and that you will be pursuing the balance through the small claims court.
  • write back rejecting their offer altogether and telling them you will be pursuing the matter through the small claims court for monies owed and costs incurred.

To go through the court you can file online at Moneyclaim - details of how to do this are in the FAQs.

Phone calls ceased - 20 August

Acknowledgement of Data Protection Act request received - 22 August

Reminder sent re: Data Protection Act 3rd September

Statements received - 20th September

Calculated penalty charges to date - £2K

5 months of Missing Statements requested - 25th September

Claim letter sent for £2K - 4th November 06

Reply with a four week timescale received - 15th November 06
