Trouble Getting Refund From Netflights

Hi all,

 

It's been a while since I last posted.

 

We were due to fly LHR - Mex - Lap (return) with AeroMexico on May 2nd.

 

The flights were booked with Netflights (owned by dnata).

 

We have requested a refund from Netflights who have stated they will only issue our refund when (and if) they receive a refund from AeroMexico😡

 

Can anybody tell me who my contract of sale is with, Netflights or the airline?

 

Is this even relevant? 

 

Who should be refunding me?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

We paid by credit card.

 

We lodged a dispute with the credit card company who said we had no grounds to do so.

 

So we have hit a brick wall down that avenue and was therefore seeking advice as to how to proceed.

Hi DX.

 

Had previously disputed the transaction with the credit card company to no avail.

 

I have now put in a Section 75 claim against the credit card company itself.

 

Probably I should have done this in the first place!

What credit card company is this? Please name and shame, as this is a clear case of refund due. What reason did they state for refusing your refund?

 

You normally fill a s75 claim with the credit card provider themselves. If the company rejects your s75 claim you can then complain to the ombudsman. I'm not sure what you mean by a S75 against the credit card company.

 

Regarding the contractual obligations. Your OTA is responsible for processing the refund claim with Aeromexico, who are in turn responsible for paying your OTA. The OTA is responsible for paying you. All of this should legally happen within 2 weeks. AM will not refund squat to your OTA unless they make a claim.

 

One problem here is that Aeromexico filed for bankruptcy in June. But they are still processing debts, so even that is not an excuse. Has your OTA even requested the refund from AM? What was their excuse?

 

And finally what is yours, since you should have been doing this on May 2nd!

 

One possible course of action to you is to call AM yourself and obtain confirmation that you are due a full refund. This is not the correct procedure, the OTA is responsible for contacting the airline, but sadly I have had to do this several times because greedy, lazy, and dishonest OTAs just don't give a damn.

Once you have that in writing or recorded the call, you present this back to your OTA, and if they refuse to hear you within a week you file the S75 claim and it won't be denied.
