Just thinking on this one, the letter I received from CEL starts with 'without prejudice' if I were to respond to them refusing their offer and offering even less with 'without prejudice' at the start of my email would they be able to use this in court. My assumption is that I wouldn't be able to use their offer letter and say "look, they're happy with £85 yet they want £330 from me today in court". 

To the professionals here, does this look like they won't even go ahead and pay the court fee to proceed? I could really do without the stress this coming december.

No worries, the important points in the N157 are there.

 

Yes, you can negotiate with them in the way you describe if you wish, although in their diseased minds they will move you from the "pain in the backside who is likely to cost us in court" list to the "may well cough up so let's keep haranguing" list.

 

They don't seem very confident with their case if they will accept £85 rather than £303 but we simply don't know if they will go ahead or not.

Thank you both. And so, their end date of the reduced offer is before the payment due date of the court. I'm assuming I can wait to see if they pay the fee before providing any witness statement? How will i be informed of court fee payment?

That would depend on their reason for discontinuing the claim whether or not there was a procedural error or simply not financially viable....but for whatever reason they would require the courts permission and that woud cost them a further £275  so its very unlikely for the amount in question .
