My partner was driving in an unfamiliar area, which was at Barking station. We were using Waze at the time and had no intention of entering a Pedestrian Zone. We received x2 PCN letters, both '53j failing to comply with a restriction on vehicles entering a pedestrian zone'. Station Parade https://www.google.co.uk/maps/@51.5387943,0...33;8i8192?hl=en PCN1 - https://i.postimg.cc/6QJxSH4D/PCN-1.jpg Tried to turn right into Salisbury Avenue - No entry Tried to turn left into Wakering Road - No entry. The only option in that short space of time was to go straight ahead. As we approached the round about ahead we looped back and took the exit through Longbridge Road as I was meeting someone (they live locally and had stated that these restrictions are new and there has not been any announcements of these changes) at Salisbury Avenue near Nando's and wanted to meet them as close to that location as possible, which is where we received the 2nd PCN ticket. Longbridge Road https://www.google.co.uk/maps/@51.5407362,0...33;8i8192?hl=en PCN2 - https://i.postimg.cc/0QvKCRGj/PCN-2.jpg Had I knew this was going to happen I would have just taken the train! Do we have any grounds to appeal against this and cancel both PCNs' or just pay for one? I would appreciate it if anyone can please help. -
you could yes but obv scan and attach one of the DCA letters to it as a PDf so they knowwhat you are going on about. there is also, and might well be advised, to also back this up by a royal mail letter, also inc a DCA letter too. that way atleast it will take you brother out of the loop.

so what if they do... a debt collector (DCA) is NOT a BAILIFF and DCA's have ZERO legal powers on ANY debt no matter what it's type dx

I hope you will notice that I've restructured your post to introduce some proper spacing et cetera so that it is readable even on a small screen. You've missed out a couple of fairly important details such as where is the item, what is it and what is its value? -
An amendment to the Financial Services Bill, due to be debated tomorrow in the House of Lords, could pave the way for people to get cashback from local retailers without first having to buy something. View the full article

Post in Court Claim Against Hermes - item sent via Packlink was lost/tampered with **WON at mediation full amount **
jj58 posted a post in a topic,
Hi @BankFodder
Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
So I issued the claim on day 15 and they requested more time to respond.
They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
I opted for mediation, and it played out very similarly to other people's experiences.
In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them.
In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.
Many thanks, stay safe and have a good Christmas!
