NE Parking windscreen PCN - outside lines - Bond Street Blackpool

I want to Blackpool on the 17th July 2020 and parked in the last bay of NE parking on Bond Street pay and display.

I paid the right amount of money.

 

We came back early to find a parking ticket on my window.

We parked best we could as cars where parked next to us.

 

The ticket said ' not parking correctly within the markings of the bay.'

this was not correct if we did it must have been a fraction.

  My partner struggles to get out of the car as he has two new hips.

 

I saw a man taking photographs of other cars, asked him why I would get a ticket, his reply was look at the board on the wall.

 

Please can you help I don't know if to pay or write to them.

There have been quite  a few complaints about this site so do  not write to them as that may reveal that you were the driver which would mean that you lose the protection of the Law.

Also do not pay them a penny.

You paid the charge- that is quite enough.

2.  Have you yet appealed to the parking company yet? [Y/N?] - 2. I have not appealed.

 

3.  Have you received a Notice To Keeper? (NTK) [must be received by you between 29-56 days] - not received any notice to keeper.

 

4.  What date is on it? N/A

 

5.  Did the NTK provide photographic evidence? N/A

 

6.  Did the NTK mention Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) [Y/N?] N/A

 

7.  If you appealed after receiving the NTK, did the parking company give you any information regarding the further appeals process? [it is well known that parking companies will reject any appeal whatever the circumstances] N/A

 

8.  Who is the parking company? NE Parking

 

9.  Where exactly [Carpark name and town] did you park? Bond Street pay and display Blackpool.

By being  less than helpful, the operative has damaged his employers chances of getting anywhere with their demands, even if you did breach the conditions. This is called mitigation. The bloke is there to be helpful as well as enforcing parking and he did neither

 

Now what we would like to see is a picture of the par park entrance, any signs there and pictures of the signs scattered about the place. Also of it is a pay and display we want to see the parking meter and any associated blurb as that wording creates the contract you have accepted, not the signs.

next thing is to measure the size of the bays, there are prescribed minimums for on road parking so a bay that is too small may well not be considered a bay. Also, were there disabled bays there and were they full?. More mitigation you see. i know you will have explained this to the bloke with the camera HAVENT YOU??( hint hint) so again mitigation and disability law comes into play
