    • It doesn't need to but it makes no difference.   What you will find is that if the judge finds in your favour, they will award the sum and ask you if you want anything else, it is at that point you claim interest and your expenses (if applicable) such as lost work etc
    • Just a few suggestions -  I wouldn't be listing the attachments in your index. Just say exhibits then have a page of an exhibit index right before the exhibits start move the defendant's evidence bit above the the previousy reported cases. I believe if you look at the macbook case, you will see similar I also think for the issues in dispute and not in should be short bullet points not full on sentences (for example point. 8 paragraph 3 isnt an issue in dispute or not its just an explanation - the list of dispute/not in dispute should be short and concise. Information about the points should be in your wintess statement. Also on page 3 you switch between bulet points and numbers, I think you shoud be using numbers throughout so you can refer to it much easier.  Also I'm not sure why you have put your issues in dispute as part of your witness statement. I would be putting this as a seperate page before your witness statement. point 25  - I would add something that says something similar to "The Defendant cannot rely on a contract they have not provided to exclude their liability" I also see lots of switching between I and the claimant. Its a mere point of how it reads but I think you should stick to one or the other not use them interchangeably. Also, I would say that your WX should have your name at the bottom above the signature. I'd also change the wording on page 8 to be just "Exhibits to witness statement of YOUR NAME" Just my thoughts and vast majority are just about the formation rather than the content
    • Hi, yes i did claim interest in the particulars of claim. I just thought it needed to also be mentioned in the WS - if it doesn't need to be in WS, then happy to take it out. @jk2054 yes, blue font is only used in the draft WS so the amends are easily visible. Final version of WS will be in black font.
    • If you didn't specifically claim interest in your particulars of claim then you won't be able to claim it

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

US elections November 2020

Trump is looking less and less popular, over Covid and other things.

I'm not sure I'd be inspired to vote for someone who thinks the cognitive test he's talking about is too difficult for most people, especially Joe Biden. Is he confusing a congnitive test with an IQ one?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I'm wondering how many voters will be turned off by the White House's handling of the George Floyd demos and the Covid crisis.

Part of the electorate will stay with Trump whatever, but at the moment he's trailing Biden in Texas which is bad news if it continues.

All Trump had to do to get re elected was make some empathetic speeches and defer to his scientists.

He screwed it up. He’s done , it’s over.

We could do with some help from you.

Problem is, the American people are dying of Covid and he is out playing golf. It's like Marie Antoinette, let them eat cake!

People laugh and snark about Boris but ultimately he had empathy, ultimately he flattened the curve of the disease, ultimately he bailed the population out financially.  Trump did none of those things.

4 months ago there was no doubt in my mind that Trump would win, This will be studied by our great grandchildren in history books as to how rapidly things can turn.

And before anyone says the polls are wrong, they are at 4 times the margin of error!!! There are 3 months now until the election, Biden is not Hillary Clinton, no mud is sticking. In fact Biden doesn't have to do a thing, just give Trump enough rope and he'll hang himself.

We could do with some help from you.

He flattened the curve of the disease at best half of what he should have

and Johnsons gov were avoiding 4 million plus hitting the universal credit system and the immediate collapse of swathes of UK businesses,

yes thats better than Trump, but given the situation and the differences in the UK, his gov would have almost certainly collapsed if he hadn't

interesting that Johnson has said there will be rises for the Judiciary, police and doctors

Well, the Judiciary have mostly been at home

Getting to actually see a GP, or even getting past 'every symptom is covid - isolate don't come in' has been and is a ferking disgrace

My other half and daughter in law, both NHS who have both been working right through the pandemic - longer hours and more responsibilities than normal

apparently still aint getting a penny extra.

Either/or

I was referring to Johnson

but Trump fits equally well there

... Just a matter of degree and what each thinks they can get away with in most areas

Like johnson would never get away with 4-9 million extra unemployed and tens of thousands of Tory voting small businesses down the pan

Trump doesn't care - cheap slave labour without using Mexicans

.. Johnson just wishes he could

Yes and at least Johnson has admitted there were mistakes in not locking down sooner, something you couldn't imagine Corbyn doing.

Surely you mean Johnson makes feeble excuses for the results of terrible personally driven policies and practices and claims it wasn't his fault

... just like Trump and Corbyn have and continue to do

I'm reading excuses - and feeble ones

"the prime minister has said he took the "right decisions at the right time", based on the advice of scientists."

"We didn't understand [the virus] in the way that we would have liked in the first few weeks and months."

" "I think it's fair to say that there are things that we need to learn about how we handled it in the early stages

""Maybe there were things we could have done differently, and of course there will be time to understand what exactly we could have done

Do read what you link

So show a single clearly defined mistake admitted or apology

From refusing PPE and UK PPE being sent to China

Lying about PPE being ordered and coming in from Turkey

Demonstrating Handshakes when there should have been care

18 million people admitted/returned into the UK untested and unchecked

SPADS and ministers P*ing all over lockdown while fining ordinary folk

.. theres lots and lots of cretinous decisions for him to pick a clear apology from

.. and not a single one - just like Corbyn and Trump

Mr Johnson said: "Maybe there were things we could have done differently, and of course there will be time to understand what exactly we could have done, or done differently."

It's nice to see he takes full responsiblity for what the government has done. But I disagree with the time to understand comment, a second wave could be pretty soon.

Yup, Johnson did a poor job, as did Macron, Spain, Italy, just nobody in this country follows any other country aside from the US and Australia.  The Belgian PM is taking, deservedly a lot of flack.

But, not one of them, Johnson included can be compared with Trump.  He is on the spectrum of normality, and believe me I don't like Boris one bit.  Trump is like Marie Antoinette, telling the people to eat cake.  The population is dropping like flies, but he is playing golf, tweeting about fake news, boasting about his achievements and some cognitive test a 5 year old could complete.

Lets not forget this is the man in control of the worlds largest nuclear aresnal, and has the ability to destroy every major city on earth. All in all it makes the likes of Boris, Macron etc, seem like small fry.

We could do with some help from you.

changes a weak but arguably an actual apology into nothing but an excuse and avoidance at best in my eyes

A simple apology with a clearly defined focus is what is needed

and given how often he does munge and obscure a required apology, quite clearly says to me that no apology was or is intended. Quite the opposite.
