Hi there,

I’m getting emails from Capquest which I thought were phishing spam for a while as the link you click goes to a dodgy looking URL.

 

Reading these forums I suspect they might be genuine and are chasing my student loan debt.
 

They have given me an account number. 


I took out 3 loans in 96, 97 and 98 when I studied in Scotland and last deferred payment in 2009 or 2010.

They only have a previous U.K. address and I have lived abroad since 2011 but I own a home in the U.K which I let.

 

I haven’t received letters at the house I let to my knowledge. 
 

My question is should I register an account with Capquest and send them a “statutes barred” letter when I see what they are after or ignore them altogether?

Never Ever communicate with the likes

of Capquest or any other blood sucking DCA via email or phone.

 

All communication should be in writing only with proof of posting.

 

All you need to do is send Capquest a letter updating them with your current address. This prevents them from issuing a court claim that you can’t defend because you don’t know about it.

 

Aside from that they are powerless, and it’s safe to ignore any call, email our letter from them unless it’s a letter before action.

We could do with some help from you.

Thanks for the fast reply. 
 

If I update them with my current non-UK address will they start sending me letters asking me to settle the debt?

 

Right now I’m just getting the odd email and most go into my spam folder.

 

Do I still owe the debt if it’s been 10 years since I last deferred?

Where can I find the letter? And do I quote the account number they have emailed to me?

debt collection section of our library

 

royal mail it from where you are - do not use electronic methods as theres no guarantee they'll get it nor papertrail proof

inc their ref number

and

any other old SLC AC details you have too.

Thank you. And does the letter apply if I do not actually know it’s my student loan they are after and I went to university in Scotland?

I don’t know as all I have is an email from them saying this is your account number

Right now I don’t know what it’s for as I haven’t clicked their link or confirmed my identity to them on their site using their reference number. I presumed from reading around this was a student loan chase.

be careful this is a fake email, i had this email over the weekend, dont click that link, go to the official site and you put that ref in and it not even real

Yes it looks very suspicious. So I should just ignore it then? When I’ve tried using it on the official site it makes me put in an address and date of birth and that’s when I’ve stopped. Partly because I don’t want to confirm the debt but also because I don’t want to hand over my data.

Ok so as I’ve only received an email from “Capquest” and it could be fake - the advice is ignore it completely?

Fair enough - I will just ignore it then. Thanks for all your help. 
 

If the real Capquest send a CCJ to an old address where I no longer live and therefore I don’t know about it  - what are the implications of that - even if the debt is “statute barred” now?

But they still can send a claim form to your

old Address. You won’t even know about it either, therefore won’t be able to defend The next thing you know is when you are turned down for credit and find a fresh, shiny CCJ on your file.

 

The answer is to let them know your current address via post. That way , if they are stupid enough to try any action, they won’t have a snowballs chance in hell of winning. You have the ultimate defence! It’s statute barred.

That’s why I’m confused. If this email is spam am I making myself visible  to the real Capquest by sending them a statutes barred letter with my real address. I mean I guess they - or another company that bought student loads - are looking for me and I think they have tried to find me in the last 10 years but to no avail.

regardless to any fake or otherwise emails.

if you have never updated any original creditor or debt owner of your correct address since moving from that address to abroad.

and you last paid or used that line of credit in say the last 7yrs you need too.

 

for things like slc loans, this is even more important.

as they can be enforceable till you meet age or time restrictions

I moved abroad in 2011 and haven’t had any credit in the UK since apart from a mortgage which is now completely paid off. 
 

I last made contributions to pay off my student loan in 2010.

 

So essentially I should just contact Capquest at random to say “Hi - I used to have a student loan and here’s my new address but I don’t think you can actually claim anything because it’s now statute barred”?

 

I have no details of my loan as I no longer have any paperwork from before 2011.
