accept their money.

get the CCA requests off

 

wait 12+2 working days.

they fail

 

stop your payments.

 

get out of their clutches

looks like they've had you dangling on a cash cow satring for years

stop being their puppet and take control of your money.

not let these leeches do it for you.

 

they really are totally powerless.

i called Lowell this week to obtain the original account numbers of both accounts so I can send SAR's. 

They said that they could see that I have requested a CCA and would I like to stop payments until I receive this. 

 

I declined but not sure if I should've done said yes to this? 

 

SAR's have been sent to vanquis and express gifts this week and Lowell have until 30 July to send me my CCA.

dx - your reply is not helpful. 

 

If your comments were clear and concise and advising me to stop payments, then I would take that onboard, but your reply is asking ME questions instead of answering them.

 

I have said before that you were being judgmental and I have read other threads on this site where other people have said the same.  You are coming across rude and it is not acceptable.

 

Please leave it to other members of the site to give me advice if you can't be nice about it!

please just stop being a DCA cash cow mule and ringing them.

you'd be debt free by now if you'd stopped that +10yrs ago.

 

as for the payments

if and when anyone you have been blindly paying fails the 12+2 working days time limit, one of your options is to stop payments.

 

i think it speaks volumes that lowell have even offered you the option to stop payments now.......

proves they've been cash cowing you for years.

 

you don't need a/C numbers to send an SAR.

I will say it in a polite way. Lowell are conning you big time, it pains me to say it but it’s the truth. Stop paying them.

 

If you are worried about the moral side of it, give the money to your local food bank instead of paying Lowell.

 

Help out people in your community who are starving due to the terrible economic crisis rather than giving it to Lowell.

London1971 thanks for your not so rude reply. 
 

I’m not concerned about the morality aspect of this debt. I am unsure if I stop payments that they can take court action as I have basically acknowledged that the debt is mine because I have been paying them? 
 

Do I just cancel the DD and ignore them or wait for the CCA then take it from there?

without enforceable paperwork, they won't go anywhere near a courtroom door..

you paying the debt is immaterial to that fact.

Lowell are one of the more litigious DCAs......so when/if you receive the agreement ...redact scan and upload and we will give opinion.

You can always resume payment if you feel more comfortable paying them.

Yup Andy and DX are very good at being able to see if Lowell’s have just copied and pasted some rubbish together for an agreement.

 

I had 2 CCJ’s from Lowell before I ever knew this site existed, that was because I hadn’t updated them with my address, and I had no idea they had sent a claim form to my old address.

 

After finding this site I sent a CCA request to my  Remaining Lowell debt, what they sent back was completely blurred and mostly illegible. As a result they closed the account and removed it from my credit file.

I did dx.

The letter from them today says they have asked vanquis to provide them with the documentation and they aim to provide it to myself within 12 days.

 

In the meantime, my account is on hold and they will NOT contact me to request payment.

If they have not heard anything from vanquis after 40 days they will send me an update

I agree this site is really helpful and I intend on making a donation as a small thank you for all the advice I’ve received over the years. I’m glad you got your default removed. Fingers crossed the same applies to myself when or if I get any documentation back from them 😊

Hi

 

just got a letter back following my CCA request for the Express Gifts account.

They have stated that Section 77-79 does not apply as this account no longer has an outstanding balance

(I paid this off £10 pm).

I’m not sure if this info is correct?

If its been assigned to Lowell it will show a nil balance.....the CCA request should have gone to Lowell.

forget that now

 

its the vanquis debt you need to concentrate on then now.

The 12+2 days will be up for the Vanquis CCA on Thursday.

What are my next steps if they don’t have it by then?

 

I have stopped the DD but in the meantime they wrote to say they have suspended all payments until I receive the CCA anyway
