    • you wont get eric and that doesn't solve your problem as thats mainly to do with private parking set asides really as most judges now view PPC Backdoor CCJ with dissent and grant it regardless.    i absolutely hate link and paul burrell he built up a £1B+ empire of wealth solely by conning debtors into paying debts they mostly didn't even owe, but in this instance you are on very shaky ground.   me pers i'd not even debated it and i'd just gone for it win or bust. once you get the set aside it should be plain sailing.   but you came for advice and i can't not be truthful here.   the only otherway to better gauge you chances is to SAR Barclaycard , get everything they hold. that will show you the cards that Link will have to play with , they might well be pants.      
    • I have read everything about these cowboys but need a little advice. I was issued my fine on 9/12/19 but only received a dated letter on 11/01/20.   Ive had all the threatening letters from DRP and now Zenith and ignored them all. My wife was driving our car but yet its my dad who's getting all the letters as he's the registered owner. They managed to get my number and rang me today, I busted them for being the same company but the guy on the phone was super aggressive. I said to him Ive spoken to Trading Standards and they told me by law a ticket has to be issued within 14 days of the offence. But as you can see it was over a month, I said this to the aggressive dude on the phone who actually knew way to much about parking fines. So I think they are actually under the same umbrella as VCS also.   He was firing back that the law doesn't state that and I should look at 2012 laws or something and the DVLA, and it takes time to get my details from the DVLA to issue my charge????   Does this mean anything to anyone pls Regards   Stuart

If yes please select 'yes' and complete the following fields. If you wish to claim interest under any other act or agreement please select 'no' and enter the full details of your interest agreement in the box below.   What dates and information should I enter in the attached screenshot boxes? Is it the date I sent the original car rejection letter through? Is the date issuing the claim the date 14 days after sending the Letter of Claim. I have calculated the daily rate of interest using the guide.   Thanks.

      I bought some clothes online in may through Evans and paid through PayPal
      returned them all seven days later
       
      I waited the 14days for my refund and no refund came
      I put in a dispute through PayPal but I didn’t get any emails to escalate the case - PayPal closed it. 
      evans said they couldn’t refund the money because PayPal have cancelled the refund because of the open dispute
       
      I contacted PayPal
      they said the dispute had been closed but Evans at no point had attempted a refund.
      fast forward to today
       
      I’ve got copies of numerous messages sent to and from twitter messages as it’s the only way I can contact them
      I’ve also contacted their customer service too
      all I get is PayPal have cancelled refund because dispute is still open.
       
      I have proved that the dispute is closed
      I have got an email saying that if Evans sent the refund they would accept it
      but up until the date I got the email they have not once attempted a refund .
       
       I have sent them a letter before court email
      I have even offered to have the full refund as a gift card just to get this sorted !
       
      I’m literally at the end of my tether and don’t know where to turn next !
       
      i suffer with mental health issues and this is affecting my health and I’d saved the money for a year to buy these clothes as I’m on a low income .

Rob Way chasing old BC debt

Hi All,

Trying to help a friend that got in to a bit of trouble when splitting from his wife. 

Ex Barclaycard debt first assigned to Hoist  and now to Rob Way.

 

Default date - 18/03/2015

Default balance - £4764

O/S Balance - £3222

The change happened 20 months ago when they offered a settlement.

CCA sent to Rob Way 02/08/2018

Pack received dated 24/06/2020 containing

BC statements from Feb 09 to Jan 15,

Assignment notice 03/09/18

letter from BC to Hoist with 'historic & varied T&C's'

signed application dated 11/2012 - attached

T&C's with a reprint date of 01/03 - attached

 

Rob Way are asking for details of how he will pay. Is there anything that can be done.

Just ignore them. Don’t pay them a penny. The only time to respond is when a letter before action is received.

 

Warning. Paying them will reset the statute barred clock.

Warning. He needs to make sure that they have his correct and current address. This should be sent in writing, if they don’t have it already. This prevents any sneaky things going on behind his back.

thats not a cca return

its an application form

and the T&C are generic from 2014 not the ones sent to him.

 

 

please don't hit Quote...just type we know what we said earlier..

 

if everyone stopped blindly paying DCA's tomorrow

the biggest financial industry in the UK, DCA;s -  would collapse overnight.

 

DCA's view debtors as suckers, marks and mugs - that's why they will never tell you they are not bailiffs and have absolutely zero legal powers on any debt.

Will correct the address as currently on mail redirect due to recently moving.

Is it worth mentioning they still haven't replied to the CCA request.

Nope not worth mentioning. Paying them Even 1 penny will let them sink their claws int him for the next 6 years. Don’t fall for their fake threats.

same with every debt he has that he's paid or used in the last say 7 yrs.

write to the owner informing them of his new address

 

never run from debt!

Hi Tony,

 

Please ensure YF does NOT acknowledge any debt  when confirming their new address.

 

They should simply state, " Please note my new address, as shown above."

 

Do not say anything about "a debt owed", or "the money you are chasing."

 

Do nothing that resets the SB Clock - ie acknowledging the debt and causing probs for the next 6 years.
