You have written evidence that your hotel is no longer available

You have written evidence that they currently have no alternative accommodation to offer you, which imho constitutes a significant change from your original package where a hotel was disclosed. Let's see them argue their way out of that.

 

Nobody on their right mind would agree to settle a £1800 balance for a trip to an unknown location, during a pandemic. They are apparently playing for time so they can keep your deposit money without having to look for a suitable alternative, or hoping that enough people bang out before they have to issue refunds. Don't let them get away with it.

 

Don't let them bring up the "terms and conditions that you agreed to". Terms and conditions are often not worth squat. Laws and regulations take precedence.

 

Unfortunately, because you paid by debit card, you cannot recover the money easily.

 

By all means, try the ABTA complaint process, see where it goes. If that doesn't work you may need to take them to the small claims court. If you go ahead, hopefully someone else on this forum will be able to advise the best procedure to follow.

 

Until you get your complain settled: 

-Do not cancel the holiday yourself. Even if you decide to give up the legal fight, keep the booking running until the very last minute.

-State clearly your intent to escalate the complaint, and take it to small claims court if required, as it is your belief that they did not provide you with a suitable alternative to your hotel after being shown evidence that you no longer had a hotel - which constitutes in itself a significant change under the package holiday regulations. Beyond that point, stop corresponding with Jet2 directly, until you send them a letter of intent later down the line.

-Before taking that step, you might want to state your personal circumstances and explain why you absolutely can't be expected to take the holiday - if you haven't tried this before. Sometimes an appeal to goodwill can work better and faster than a confrontational attitude. If this goes to court later, or gets media attention, it may be interesting for the public to see that your vulnerable situation was disclosed and neglected. The decision is of course up to you.
