Lowell 20% discount on mobile Phone Contract debt

Hi,

 

Hope everyone is well.

 

I am helping a friend sort out their finances.

 

They defaulted on a phone contract and it is now being looked after by Lowell.

 

Recently they wrote to them offering a 20% discount on the balance, as it is a phone contract sending a CCA wouldn't bring any details and am after some details on what to do next.

when did she take this out?

and why did she stop using the service?

has she moved since getting the contract too?

 

most of these supposed mobile debts are the remaining monthly charges until the end of contract - total unenforceable on a service that was already disconnected by the original provider

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

Mobile phone contracts are not covered by the CCA1974 therefore you cant request a copy of the agreement.Start by asking your friend what date was the default...was there any dispute.....do not respond with Lowell until you have done further research on the debt...it may be statute barred.

So a years payments made and then stopped possibly just in or out of contract.....and this is the residue being chased for a service that was never used or could be used because the service would have been blocked anyway......ignore the chase letters......comeback if and when they mention " Court Claim "

Thanks I did think that after reading up on other posts.

She has had the same address for over 5 years so all letters will be at her address.

all pre-school letters in whatever colour crayons are not a letter of claim under the pre action protocol from a solicitor.
