    • Massive issues from Scottish Power I wonder if someone could advise next steps. Tennant moved out I changed the electric into my name I was out the country at the time so I hadn't been to the flat. During sign up process they tried to hijack my gas supply as well which I made it clear I didn't want duel fuel from them but they still went ahead with it. Phoned them up again. a few days later telling them to make sure they stopped it but they said too late ? had to get my current supplier to cancel it. Paid £50 online to ensure there was money covering standing charges etc eventually got to the flat no power. Phoned Scottish Power 40 minutes to get through they state I have a pay as you go meter and that they had set me up on a credit account so they need to send an engineer out which they will pass my details onto. Phone called from engineer asking questions , found out the float is vacant so not an emergency so I have to speak to Scottish Power again. Spoke with the original person from Scottish Power who admitted a mistake (I had told her it was vacant) and now states that it will take 4 weeks to get an appointment but if I want to raise a complaint they will contact me in 48 hours and it will be looked at quicker. Raised a complaint , complaints emailed me within 24 hours to say it will take 7 days till he speaks with me. All I want is power in the property would I be better switching over to EON who supply the gas surely they could sort it out quicker? One thing is for sure I will never bother with Scottish Power ever again.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right, am feeling quite organised, already had all of my bank statements from when the account was opened, so have written the prelim letter. Putting in request for £1321.20. Was quite shocked when I added up how much in charges we have paid over the years. So am going to post the letter today. Wish me luck, I am feeling quite scared.

Hello and Welcome, no need to be scared, it's your money and the worst then can do (and probably will at this stage) is say "No" whereupon you follow the process outlined on the threads below and elsewhere on the forums.

Got letter back from Nationwide today saying sorry you are not happy, charges fair, consider alternative banking arrangements etc. I take it this is the standard letter that most people get and I will wait until the 14 days are up from the prelim letter and send the LBA.

Thanks for the encouragement. Like most people I am worried that I will be the person that they decide to make an example of and take go to court. Just curious, when did you start your claim??

Hmm that's what I am hoping. Hubby is scared stiff that I have opened a huge can of worms and wants nothing to do with it until the money is in the bank....wuss!! I am prepared to fight all the way:D

haha. Make sure you don't spend it all on HIS christmas present then!

 

You WILL be succesful. Just dont be put off by the refusals and waffle from the banks though. They know they cant win but just try to scare you and make you back down. Persevere and enjoy your money. After all, it was yours to start with!!

Hi all, right, sent my LBA last Tuesday, no response as yet. I have registered with MCOL and am putting together my claim. I have read through the step by step instructions and am ok with what I am doing. The legal stuff is a bit scary so could someone just check what I have put on my claim and tell me is it ok? Is there something missing??

1. The Claimant has an account

xxxxxxxxxxxx with the Defendant, opened

August 2002

2. Since 25/11/2002the Defendant debited

charges in respect of purported breaches of

contract.

3. Defendant is aware of all details as a

list of charges has already been supplied.

Another copy will be sent.

4. Claimant contends: (a) The charges

exceed the Defendant's losses caused by the

breaches; (b) The Term permitting the

Defendant to levy such charges is

unenforceable under the Unfair Terms in

Consumer Contracts Regulations 1999, Unfair

Contract Terms Act 1977 and at Common Law.

5. Claimant claims: (a) return of the

amounts debited of £1471.50; (b) Interest

per S.69 County Courts Act 1984 of 8% -

£244.27 continuing at 8% until judgment or

settlement at a daily rate of £0.32;

6. Alternatively, if the charges are a fee

for a service, then they must be reasonable

under S.15 of the Supply of Goods and

Services Act 1982.

7. Costs allowed by the Court.

Looks OK to me. As long as you used the spreadsheet to work out your figures and the little formula on there to work out your interest rate, then you're laughing. Submit your Moneyclaim online & pay your court fees (which they refund when you win) and you'll be looking at around £1800 dropping into your account within the next 7-10 days!!

Should I send a copy of the spreadsheet and the claim form from the MCOL website to the bank so that they have a copy of the spreadsheet with the 8% interest showing... or something. I am asking 'cos if you fill in the N1 for a claim you have to attach a copy of the spreadsheet but there is not that facility with the MCOL service.

Hi,

I have sent a LBA to Nationwide and they have not replied even though the 14 day deadline has passed. I know the next step is court action (isn't it?) but i'd like to ask how to go about my claim. I haven't paid the charges. I stopped using the account when the first charge came in, the interest accumulated from £30 to over £200. How do i claim that, since the charges are not 'from my pocket' but on my account????

I was expecting mine to take a bit longer, cos its a closed account, so I will need a cheque.

Hi all my claimed was issued on the 30th (had confirmation by mail)

They 'defended'

Checked my balanc today and on the 2nd the following payments were made into my account:

Now my claim is still £1k short so keep checking your account
