    • They have defended the claim by saying that the job was of unsatisfactory standard and they had to call another carpenter to remedy. My husband has text messages about them losing the keys a second time and also an email. What do they hope to achieve??? Most importantly,  as far as I have seen online, now I need to wait for paperwork from the court, correct?
    • The Notice to Hirer does not comply with the protection of Freedoms Act 2012 Schedule  4 . This is before I ask if Europarks have sent you a copy of the PCN they sent to Arval along with a copy of the hire agreement et. if they haven't done that either you are totally in the clear and have nothing to worry about and nothing to pay. The PCN they have sent you is supposed to be paid by you according to the Act within 21 days. The chucklebuts have stated 28 days which is the time that motorists have to pay. Such a basic and simple thing . The Act came out in 2012 and still they cannot get it right which is very good news for you. Sadly there is no point in telling them- they won't accept it because they lose their chance to make any money out of you. they are hoping that by writing to you demanding money plus sending in their  unregulated debt collectors and sixth rate solicitors that you might be so frightened as to pay them money so that you can sleep at night. Don't be surprised if some of their letters are done in coloured crayons-that's the sort of  level of people you will be dealing with. Makes great bedding for the rabbits though. Euro tend not to be that litigious but while you can safely ignore the debt collectors just keep an eye out for a possible Letter of Claim. They are pretty rare but musn't be ignored. Let us know so that you can send a suitably snotty letter to them showing that you are not afraid of them and are happy to go to Court as you like winning.

    • My defence was standard no paperwork:   1.The Defendant contends that the particulars of claim are generic in nature. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 2. Paragraph 1 is noted. The Defendant has had a contractual relationship with MBNA Limited in the past. It is therefore denied with regards to the Defendant owing any monies to the Claimant, the Claimant has failed to provide any evidence of proof of assignment being sent/ agreement/ balance/ breach or termination requested by CPR 31.14, therefore the Claimant is put to strict proof to: (a) show how the Defendant entered into an agreement; and (b) show and evidence the nature of breach and service of a default notice pursuant to Section 87(1) CCA1974 (c) show how the claimant has reached the amount claimed for; and (d) show how the Claimant has the legal right, either under statute or equity to issue a claim; 7. As per Civil Procedure Rule 16.5(4), it is expected that the Claimant prove the allegation that the money is owed. 8. On the alternative, as the Claimant is an assignee of a debt, it is denied that the Claimant has the right to lay a claim due to contraventions of Section 136 of the Law of Property Act and Section 82A of the consumer credit Act 1974. 9. By reasons of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed or any relief.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It can only be defaulted once so if they do put anything on your CRA files just get it taken off.

 

Lloyds like to chop and change DCA's..

..guess whoever gets them the best deal gets the work plus DCA's get paid on commission so they like the accounts that take a couple of calls to get big money in.

 

People like you that pay what they can afford over a very long period don't interest them.

 

I guess you had a Lloyds bank account so any charges for missing payments etc will be on that account.

 

You should also check how long after you defaulted they moved your account to their debt collection section and froze interest.

 

Mine took nearly 6 years to move and over £3k of interest was added.

 

 

I got them to remove that from the balance.

hi,

i have a very old debt from a lloyds account and loan (in 2001 and for £10k) it was handed over to a Debt Collection Agency in approx 2004

i have paid 40 pound a month ever since. o

 

ut of the blue the DCA has sent me a letter saying i can offer an amount to pay it off.

 

two questions ,

will they except a low offer? and

will it appear on my credit score if i start negotiating/paying it off?

 

its taken me years for it to finally be off my credit report and i dont want it reappearing!

Edited above you mean Debt Collection Agency not credit agency.

 

Providing you stipulate that any offer is in full and final settlement and you get that conformation in writing...then its your choice to settle it.No it wont reappear on your CRAs.

 

However.....who is the DCA ? and have you ever requested a copy of this loan agreement from either the original creditor or the Assignee (DCA) ?

Thanks Andy the dca is wescot credit services, I have never asked them for a copy of the loan agreement.

 

I'm worried about the credit report because the letter says

'please note if you chose to repay your account by a settlement this will be recorded on your credit file as being partialy satisfied but you will not need to pay the remaining balance. This information will remain on your credit file for 6 years from the date of default '

 

I'm guessing because the default was over 6 years ago it won't be added? 

 

How low can I offer to settle?

Hi all,

 

I had a default on loan and overdraft with LLoyds Bank in 2006, around £11k was passed to Allied DCA

i paid £40 a month until 2012 when Wescot took on the account, I have been paying £40 a month ever since. 

 

i now owe £3729.

I just spoke to Wescot,

they have sent the odd letter over the years but this is the first time I've spoken to them.

They said they are  still working on behalf of lloyds and haven't 'Bought' the debt.

 

i have asked them to go back to LLyods and see what they can offer as a settlement.

 

firstly I'm surprised they are working on behalf of lloyds I thought they would have bought the debt?

 

I've paid nearly £8000 back, i'm sure Lloyds would of settled for that?

 

 Its 16 years old this debt, i want it gone!

i should of Stature Barred it after 6 years!

 

can any one give me advice on how to write this off?

i feel I've paid my debt, I've paid £40 a month for 16 years never missing a payment!

 

I know from other threads people have said 'ignore it, they cant chase you for it', but that is not an option for me, i don't want that stress! and I'm worried that they say they are still working on behalf of LLoyds and that Lloyds could take on the debt again at any time.

 

I now have a great credit score and i don't want anything bad appearing on it!

we also told you wetcloths never by debts only ever chance for their stated client.

Hi,

I have a current account debt and loan account debt both with LLyods (original default and debt from 2005 £11k),

they have been consolidated into one debt and I now owe £3729.21 after paying £40 a month for 15 years!!

 

I asked for SAR and CCA back in 2006 which they sent me and deducted charges and interest from the debt. 

 

The debt has been handled by Wescot Credit Services for most of that time.

I realise I could of stopped paying and it would of been statute barred years ago! but I chose to try and pay it off.

 

however, I now think I have paid my due!

15 years of £40 a month has paid off a huge sum of the debt.

 

I have recently requested the CCA again.

Wescot has responded saying the current account debt has no agreement and they are chasing Lloyds for the CCA on the loan,

I haven't requested SAR as this was done in 2006.

 

I have also offered a small amount of £400 as a full and final settlement,

Wescot are waiting for LLoyds response but have informed me that any reduced offer would be logged on my credit report as partial paid.

 

A: am I right in thinking nothing will appear on my credit report as I defaulted so long ago, even if I stop the £40 a month? I now have a good credit score!

 

B: can they enforce the debt on the current account as there is no CCA?

 

C. any reduced offer I make, I want them to agree that its 'full and final settlement' am I right to think this?

 

D. any other advise would be gratefully received!

 

I know a lot of advice is 'just ignore them', 'don't pay them' but I want to be sure that I wont get bad credit and I wont have debt collectors knocking at my door!

its been so long, I just want it over now.

to answer point b first,

yes they can enforce because you have acknowledged the debt by paying Wetcloths all these years!

 

c. that is up to LLoyds so dont take wetties word for anything

 

what you need is a statement of account going back to 2005 as I would surmise that when it defaulted there wasnt a mechanism to charge interest or fees.

 

how was it consolidated into one,

did they give you a new loan and then you defaulted on that?

If not then they are 2 separate debts because they have different terms and only  will have the credit agreement that means interest COULD be payable

It should be long gone off your credit file, dropped off on the 6th anniversary of its default. 
 

They are lying to you , nobody has the power to restore a default on your credit file that has dropped off. Least of all a powerless DCA. Stop paying them!

 

just make sure they have your current address , so that they can’t do anything behind your back

it was consolidated when passed to Wescots so it must be two separate debts still, although wescots haven't broken it down into two separate accounts, so I don't know what is owed on each.

 

I did ask for a SAR in 2006, and interest was taken off.

are you saying I should request another SAR?

I don't think i've been paying interest.

 

if I stop paying them, what will happen?! surely LLoyds will chase me?

I don't want debit collectors on my doorstep or bad credit from this.

 

its taken me years to rebuild my credit score!

I’d say you are being totally had by Westcott. £40 per month is a lot of money. Honestly if you

really don’t need it, plenty of charities are desperate for income right now. Anything but paying those parasites.

 

Westcott are not bailiffs they are powerless DCA’s who will not turn up at your door.

 

Bad credit is impossible as there is no trace on your credit file anymore.

 

As for Lloyds, don’t worry! Seriously. I got a son doing GCSE’s younger than that debt!

you've beern had blind by wetcloths for 15yrs.

 

sar Lloyds and check you money HAS been going off the debt....

I bet you'll find that the debt was sold off years ago and wetcloths simply forgot to tell you their client had changed.

and Lloyds haven't seen a penny for years...

 

it is extremely rare for Lloyds to do court...and they most certainly wont on debts of this age if they are still the owner of the debts.

same will go for a dca debt buyer if it has or gets sold on..

It won't touch your credit rating. Lloyds won't do anything. It's ancient debt, plus banks don't do court because it's seriously embarrassing for them if they lose.

I value this sites and your advice.

I couldn't add to the old thread so started a new one. 

 

I have done what you have suggested, sent CCA, sar (I got interest and charges taken off) 

 

The only thing I haven't done is ignored them and stopped paying.

That's because it scares me and stresses me out!

I'd rather offer them a settlement, or for them to acknowledge its over!

Unfortunately however you feel . Every penny that you give to them is a waste of money. Any settlement that you give them is simply throwing cash away. You want it to go away? It’s already gone away.

 

As I said before there is massive hardship out there , and it’s getting worse. If that money is really burning a hole in your pocket, donate it to your local food bank, domestic violence refuge, homeless charity. Even go spend it in your

struggling local shops. Just do not, for the love of God give it to a bottom feeding, powerless DCA!
