Hi

 

I have spent a lot of time reading the threads on this site and those found on MoneySavingExpert.com ad-free, free to use, Consumer Revenge! and have decided to reclaim back what is mine.

 

I know the Abbey have taken a fair amount of bank charges off me over the years, but I can't even begin to try and calculate how much.

 

I ask myself "Why did I let them get away with it", well, not anymore.

 

So my reclaim story begins:

 

I have sent my DPA letter to Abbey and confirmed their receipt of it through the royal mail web site.

 

They have 40 days starting from the 21st November (2006) (I have put the year in as I just know it's going to be a long slog).

 

I guess I will get the usual fob off letters, but having spent some time reading the threads I know what to expect.

 

I will keep you posted.

 

One question:

 

Are there any email addresses for direct contacts within Abbey, as I would rather send them correspondence using email as apposed to snail mail.

Hi, best of luck with your claim. As to your question, have look at the top of this forum under "contact Details" there might be some email addresses there. not sure if that's the best way to deal with Abbey and i doubt it will be quicker doing it that way but i guess its worth a try.

I received a reply from Abbey today regarding my DPA letter.

 

They confirmed receipt of my letter and payment, and advised they would post me copies of my last 14 months worth of statements in the next 5 - 7 working days, however the remainder are archived onto microfiche.

 

They did say that they have made arrangements to send me a list of my archived transactions for the period 2000 - 2005 to be sent under seperate cover.

 

I must say, reading some threads I was not expecting a response so soon and was expecting the usually fob off letter, suggesting I could not have them.

 

I guess this is more of an acknowledgment letter, and I will end up waiting for the whole 40 days after all.

 

Well, we will see if I receive the last 14 months in the next week or so.

I received 13 individual letters from Abbey today, each contained a duplicate statement.

 

I have gone through all of them, plus the latest online statement and calculated they have taken £417 from me.

 

£111 of this is "Interest Charged whilst account overdrawn", I guess I can't claim this back as it is not an actual charge, but simply an amount I pay for the overdraft facility.

 

Could someone confirm this, has anyone claimed this charge back!

 

We will have to see how soon they send the archived microfiche statements so I can continue to add it all up.

Ok, I get it now.

 

I have started to input some of my charges on the advanced spreadsheet and it all fell into place.

 

My understanding.

 

Although I can't claim back the full amount of "Interest charged whilst account overdrawn" I can claim back the amount of interest I have been charged as a result of their unlawful charges.

 

Therefore, if I had been charged £150 in one month, plus £10 (Interest charged whilst account overdrawn), had I have not received the £150 charges I would have paid a smaller amount of (Interest charged whilst account overdrawn) it is this difference I can claim back.

Should I use the simple excel spreadsheet under these circumstances, if so, why is it calculating an additional 8%, I thought that was just when the claim goes to court.

 

Should I just request the bank charges back and forget the interest charges on the overdraft?:confused:

Sorry brains not working too well at mo but i think the above is more appropriate if you want to claim contractual interest otherwise stick with the simple charges version. it does just as good a job.

I used this as it was simpler also as to interest charged while overdrawn you can request this back as long you can prove that you had gone overdrawn because of the charges applied on you account. The 8% interest calculation formula is already set up however, just remove that section and send the rest off with your preliminary letter. After that if they still haven't paid up and you have to lodge your claim then you can include that section.

Its up to you however i don't see why i mean if you can show that the charges alone made you overdrawn then why not claim it?

Thanks bp, I think I will stick with the simple spreasheet and just calculate the charges.

 

No doubt I will end up sticking 8% on soon after as I doubt they will just give in and pay up this early.

Well, I must be going soft in my old age.

 

I calculated my charges just before Christmas a decided to allow Abbey a little bit of time before I sent my prelim letter.

 

I thought sending the letter just before Christmas was a bit mean and not very in keeping with the seasonal spirit.

 

However, Christmas is over and the New Year is here and it is now time to let the battle commence.

 

My prelim letter will be sent tomorrow requesting they return £994.50 to me.

 

I don't expect a speedy resolution but here's hoping.

I received a letter today from the banking specialist team at Abbey.:eek:

 

The letter mentioned high quality customer service is of great importance to them and they will do everything they can to resolve my complaint in a timely and satisfactory manner.

 

Great, does that mean they will give me my money back tomorrow, I think not.:)

 

However, a thorough investigation is sometimes needed and this can take time, if they have not contacted me before then, they will write to me in four weeks to let me know what is happening.:-x

 

Sorry, did they not say "They will do everything they can to resolve my complaint in a timely and satisfactory manner":rolleyes:

 

Seems to be a contridiction in terms to me, besides, their meant to be the banking specialist team, can't be that specialist then.

 

I have written my LBA and will post it recorded delivery tomorrow, giving them the usuall 14 days to pay up before I take further action.

What a surprise, checked my account and found a list of refunds totalling £350.:o

 

No call or letter from Abbey first.

 

I expect to get a letter offering this as a GOGW, well, thank you very much

 

Oh, by the way, you have 8 days left to refund me the remainder or off to court we go.

 

I will post my letter accepting my GOGW as partial payment and sit back and see what happens.:)

I received the letter from Abbey, offering me the £350 as GOGW.

 

Drafted a letter accepting as partial payment only, giving them until the 1st Feb to cough up the rest, will post tomorrow.

 

Abbey, Is another £600 really worth all the hassle, just pay up and I will go away.

Hi

 

Time was against me, due to other commitments I left it a bit late and felt the 1st of Feb was a bit tight, I have therefore sent a letter accepting the GOGW as partial payment and advised them they have until the 13th Feb to reply before I start court proceedings.

 

The letter has been posted (registered post) 31st Jan so I await their next move.

:) Hi Mark, I did exactly the same thing. I'll start the court procedure in 2 weeks as well and guess what? I've just received another classic letter from them ( I'm sorry you felt ..............):mad: What a joke! Let me know what is their reply to you. Take care.

I guess I will receive similar.

 

Not sure how much you are trying to claim, but if I was in their position I would just pay up.

 

£600 pound is all i'm asking, it would cost them more than this in time and effort.

 

You would think if they were that clever with their money, they would just do what is right, and save all the hassle.

At least you received a GOGW even if it isn't anywhere near the full amount. I got zilch, just a letter which basically stated that all the 'evidence' in my letters to them referred to credit cards, not bank accounts so therefore wasn't relevant to them.

 

Yeah, we'll see what the courts say about that.
