That is the reason I posted my opinion, because I am trying to learn more and this is one of the ways to learn, by posting my opinions and if I am incorrect then being advised of the reasons I am incorrect. I am not sure if you have educated me on the points in my post that would be incorrect. However, you are correct on one point, I shall refrain from posting on any other thread other than my own going forward and if you think my post here is unhelpful, misleading or in any other way inappropriate, then please do feel obliged to delete it but educate me on the reason why. To help my learning process, it would be helpful to know what I got wrong other than it goes against established advice considering the outcome of a recent court case on this topic that seemed to suggest it was dismissed due to an appeal not being made at the first stage. Thank-you.   EDIT:  Just to be clear, I am not intending to go against established advice by suggesting that appeals should ALWAYS be made, just my thoughts on the particular case of paying for parking and entering an incorrect VRN. Should this ever happen to me, I will make an appeal at the first stage to avoid any problems that may occur at a later stage. Although, any individual in a similar position should decide for themselves what they think is an appropriate course of action. Also, I continue to be grateful for any advice you give on my own particular case.

    • Yep, I read that and thought about trying to find out what the consideration and grace period is at Riverside but not sure I can. I know they say "You must tell us the specific consideration/grace period at a site if our compliance team or our agents ask what it is"  but I doubt they would disclose it to the public, maybe I should have asked in my CPR 31.14 letter? Yes, I think I can get rid of 5 minutes. I am also going to include a point about BPA CoP: 13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place. I think that is Deception .... They giveth with one hand and taketh away with the other! One other point to note, the more I read, the more I study, the more proficient I feel I am becoming in this area. Make no mistake DBCL if you are reading this, when I win in court, if I have the grounds to make any claims against you, such as breach of GDPR, I shall be doing so.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Silly me..a lightbulb moment ...

 

Should have realised sooner that their insurance [problem] is all part of the profits game, is widespread and has been for years both here and in the US.

 

They claim your insurance is overdue or faulty, then they put you on their block insurance. You eventually prove your own insurance is valid and then they refund your payments against your arrears or account, not back to the method they were made. Plus their insurance company gets a cut of the fees and their books look good.

 

I think a few people have mentioned they too have had insurance problems, apart from myself. It is a deliberate attempt to take money and retain it. Obviously you budget for your mortgage so when they start charging you for insurance and taking the extra payments it can only have a negative effect even if you are not in arrears.

They claim I am not paying anything for insurance but cannot or will not account for why the payment part seems to disappear into the ether. Are they just stockpiling this cash. If so, is that misappropriation? Or is part of it secretly paying for a block policy I DO NOT NEED? Mr Marek?

"136 Legal assignments of things in action

(1)Any absolute assignment by writing under the hand of the assignor (not purporting to be by way of charge only) of any debt or other legal thing in action, of which express notice in writing has been given to the debtor, trustee or other person from whom the assignor would have been entitled to claim such debt or thing in action, is effectual in law (subject to equities having priority over the right of the assignee) to pass and transfer from the date of such notice—"

 

s.136 means that unless a notice has been given to the debtor / borrower, the assignment can only be equitable.

 

Could you comment on the following:

Many of us have received notificaton from Capstone(mortgage administrator-within the Mortgage Administration agreement), that we are to name the household insurer as 'Eurosailxxxxx as mortgagee'.

 

‘The policy schedule must note the interest of Eurosailxxxx First Charges as mortgagee

 

a) Would you regard this as notice to the borrower as a 'perfection event'?

 

b) Regardless of the literal statement of 'Eurosail as mortgagee', does this notice confirm the assignment is now legal?

 

c) If now that the legal title has been 'perfected', then does the previous charge by SPML/PML become redundant?

 

d) If the SPV is the legal title holder, under LRA 2002 s27(3)&(4), does it have a duty to register its new charge?

I have very clearly posted my views with regard to equitable and legal assignment in relation to securitisation on numerous occassions (over a period of many months)

 

I will leave people to draw their own conclusions and wish anyone considering using this argument in Court, the best of luck.

Itbg re: your previous post.when did you reveive notification that eurosail was to be noted as first chargee and motgagee.please state or copy the letter exactly as stated by capstone.

with regard to previous recent posts if this has been recently stated by capstone it could mean that the assignment of the legal title from spml and pml is taking place.

please post all links this needs carefully looking at.

Crapstone has certainly raised the issue as have numerous others. The question remains why would the buildings insurance need to have anyone other than the mortgage provider named? A very simple question to which the TPA craphead seem to have NO answer.

Personally, I would suggest everyone reads "perfection act" & "perfection event" and then draws their own conclusions

Its the old cookie of legal and beneficial ownership again.The beneficial owners retain all benefits from the property ie if it burns down they get paid.The legal ownership is just the legal title ie:spml and pml are the enforcers and trustees for eurosail who own all the benefits derived from the property ie mortgage repayments.

EXAMPLE.YOU BUY A PROERTY WITH YOUR WIFE LETS SAY SHE OWNS OTHER PROPERTY SO FOR CONVENIENCE YOUR NAME IS REGISTERED AS SOLE PROPRIETOR AT THE LAND REGISTRY.SHE HAS PAID THE WHOLE PURCHASE PRICE FOR THE PROPERTY AND ALL THE OUTGOINGS,MAINTENANCE ETC.LEGALLY YOU ARE HOLDING THE PROPERTY ON TRUST FOR HER.SHE IS OWNER OF 100% BENEFICIAL INTEREST IF IT IS SOLD SHE IS ENTITLED TO ALL THE PROCEEDS THAT IS BENEFITS , YOU ARE MERELY A NOMINEE AS ARE SPML PML ETC.EUROSAIL IS YOUR WIFE.THE ONLY POWER YOU HAVE IS A POWER OF SALE BUT YOU WOULD NOT RECEIVE ANYTHING FOR THE SALE IT WOULD ALL GO TO YOUR WIFE.(IF OF COURSE SHE PROTECTED HER INTEREST WITH THE LAND REGISTRY EUROSAIL HAVE NO NEED TO DO THIS AS THEY HAVE CONTRACTUAL PROTECTION)

What I've found on the insurance front is part of the [problem] they pull and intended to cause arrears but maximise what they can get from you.

 

Initially there is confusion in payments made..by which time they have already taken your cash and will only refund it to the mortgage account regardless of any arrears. This may well put you ahead in payments (total balance) but it's shortening your available cash to make the next payments and not taken into account of any arrears that may accrue.

 

From day 1 we had problems with the insurance but they still take the payments. They refund them to the mortgage account and not your bank account despite not having any arrears. Keep that up for a few months each year when you already stretched on repayments .......

 

Something will give and they get the benefit of Royal and Sun Alliance plus your overpayments that you wouldn't have otherwise made because you have your own insurance.

 

My insurance isn't due until late November, they want a 'new' policy (not just a copy of the existing one or a fax from the company to confirm it's still in place) or they can't guarantee that I won't be charged block insurance from September onwards.

 

Don't let them be in contol of your payments.

Refuse to add the name..either Eurosail or others such as Mortgage Funding 2008. As long as you name the lender it's up to them to make the arrangements and any such term can't extend beyond your contact and into an arrangement with your own insurer on such vague details.

 

The lender has only an interest in the building as per their own details on their block insurance that they would invoke. To ask for more is ...

GR This means then that the ''merde'' finally hit the fan. These notes are not performing and the issuer has no funds left why he wants to invoke his rights to swap and the guarantees he has from Lehman Special Financing (in liquadation). So far, PML/SPML etc. are not directly involved as the issuer, on behalf of himself and the note holders, is trying to squeeze some ''juice'' out of the Lehman carcasse. I still think the better idea is to stay on the side of being a 'stupid' consumer who relied upon the information provided by a regulated profession.

 

I don't think any of us intended to stay with the lender and probably wouldn't have signed up if we were fully aware that we'd end up with Capstone or an administrative company from the outset.

 

Let's face it, we paid money to get these mortgages..it wasn't free and it didn't do what is said on the tin ..before this all happened.

 

Do what you can to stir.....every complaint helps to support what may be going on in the background.

Please could I re-inforce Crapstone's comment about fonts, colour and size. As a mortgage broker (yes, the good ones have survived) I help with advice when I feel I can make a positive contribution, but my problem is always time. Consequently, when we post could we please keep in simple, lower case, black print, minimise exclamations and to the point. Thanks.
