    • Is there a reason they took so long to send the PCN? The car was on hire or a change of address perhaps. As they have not claimed to be using POFA it is important that you do not reveal the identity of the driver. No POFA means they cannot pursue the keeper so just ignore everything from them and their unregulated debt collectors and ignorant second rate solicitors. [Sorry that was a slur on second rate solicitors].  Just ignore them all. To go to Court they need the name and address of the driver so if you ignore them there is no chance they will find out. While that does mean that you are not liable to pay them a penny they won't look at it like that and pretend that you do owe them-probably escalating the bill every time they write. This works in your favour as the most that they can ask is the amount on their signage but they always seem to want to overcharge which gets them a slap.  All you have to do is let us know if they stupidly decide to send you a Letter of Claim [it's probably more greed than stupidity but they do both of them so well it is hard to know which one it is.]. If you do get an LBC come back to us so we will give them a snotty reply which may be enough to see them off. In the meantime go on with your life safe in the knowledge that you owe them nothing and there is nothing they can do to change that.
    • I must confess to not even thinking about telling them, especially since I haven't heard anything from them for years, they weren't on my to contact list.   I always come here for advice before I reply and I am certainly not paying anyone unless I have too ( 1 ccj is being paid at £1 a month)    Since getting my head out of the sand I have been very careful on keeping all letters and taking advice before I respond and keeping copies of all correspondence.        
    • images/posts removed . please do not post jpg picture images directly to a post . read upload and redact in jpg then convert using on of the listed websites there to convert to one multipage pdf only . that way only logged-in,registered and approved caggers are the only ones that can download and see them . else anyone can see them caggers or not.     ... also please just type. there is no need to hit quote each time you post.   ........   this is getting to look better for you. but i cant see how just because you collected the car, by default you have to pay to return it... does work like that under contract cancellation as you know.   dx      
    • you must always inform any debt owners of a change of address in writing by royal mail     as for your other accounts being managed by cabot.. i hope you are not blindly paying them anything without checking enforceability first? else this could explain whats going on..they want to mug you on this debt too!    
    • Perry Mason, Honeybee? My  grandmother used to tell me about him.😀   Honeybee is right-it is very informal-no wigs and no hangman's cap. You refer to the Judge as Sir or Madam and they will be in suits as you should be too, plus wearing a tie. Do not interrupt the Judge and always be polite to the Judge.   If Yasmeen does not appear suggest to the Judge that it would be unfair that their brief is allowed to cross examine you since you have been denied the chance to cross examine her and there were many things that required examination in her WS.   Try not to gloat at the end. Good luck.   Do not forget to claim your expenses-time off work, travel, parking and £19 per hour  legal work.

      I bought some clothes online in may through Evans and paid through PayPal
      returned them all seven days later
       
      I waited the 14days for my refund and no refund came
      I put in a dispute through PayPal but I didn’t get any emails to escalate the case - PayPal closed it. 
      evans said they couldn’t refund the money because PayPal have cancelled the refund because of the open dispute
       
      I contacted PayPal
      they said the dispute had been closed but Evans at no point had attempted a refund.
      fast forward to today
       
      I’ve got copies of numerous messages sent to and from twitter messages as it’s the only way I can contact them
      I’ve also contacted their customer service too
      all I get is PayPal have cancelled refund because dispute is still open.
       
      I have proved that the dispute is closed
      I have got an email saying that if Evans sent the refund they would accept it
      but up until the date I got the email they have not once attempted a refund .
       
       I have sent them a letter before court email
      I have even offered to have the full refund as a gift card just to get this sorted !
       
      I’m literally at the end of my tether and don’t know where to turn next !
       
      i suffer with mental health issues and this is affecting my health and I’d saved the money for a year to buy these clothes as I’m on a low income .

Hi,

A few years ago I know I took out a few payday loans.

However, It seems I may or may not have had one with a company called Payday UK.

 

Last year I started getting letters from BW Legal asking for payment

in September last year I sent off a CCA request to see I could shed some light on this debt.

However,.that was the last I heard from BW Legal

 

a couple of months back I got a text from CRS asking payment of exactly the same amount as BW Legal.

I assume it's a parent company of theirs and it's moved desks.

 

They text virtually every day and I have been ignoring them until they suddenly say they have escalated it to their Legal team for review (and their reference number for this account has changed twice now)

 

Last Friday at work I sent them an email stating that I'm still waiting for my CCA request to be actioned from their sister company BW Legal and to stop sending daily messages.

 

It didn't stop them and on Sunday I sent them another email telling them to stop again and demanded the information I requested.

 

Today I actually got an email response.

 

Thank you for your email 

Loan ID:231******

Brand Name:Payday UK

Original Loan Date :23/06/2016

Original Loan Amt: 650

Interest n charges: 354.61

Paid to Date:0

Employer: *******

 

And then asking me to set up a payment plan!

Surely this isn't what I expected from a CCA request

 

Any suggestions on what to do next?

Yes I had moved since the time that the loan was taken out but the CCA request came from my current address which both BW Legal and CRS have.

 

It says the client is Payday UK

 

I got another text message an hour ago that says this

http://www.mycrs.co.uk/l/?????? It's not too late to stop legal action. Settle the £1004.61 due to Payday UK. Ref EAGPDB??????

BW Legal have nothing to do with CRS. 

CRS have recently launched their own Legal Outfit - CRS Legal but the account will remain with the original holder - Much like PRAC and BW Legals relationship back in the day... *Checks Watch*

 

Im sure that BW Legal wont have farmed this out to CRS. I think it will have been pulled back by the Portfolio Holder and reassigned.

Does this mean I would need to send a new CCA request to CRS?

 

I admit I was under the impression that any debt was sold on to a new collector that they had to let you know lol

Id let @dx100uk advise.

I believe you can but even so - I dont actually know if PDUK still hold this account to which this would be a bad idea? 

 

The issue here is that PDUK sold a lot of accounts to PRAC Financial (Rather ICL Ltd did) but i think they started doing themselves through CRS recently. 

 

Being in administration - I think they are trying to get as much money as possible to pay Creditors.

why haven't you sent them an IRL complain?

if your credit file was crap when you took this out, they might even owe you money, if you did ever pay anything at the time?

To be honest never thought about complaining.

 

So at the minute it's best to ignore the threatening texts from CRS?

 

I notice they only ever send emails and texts . They never call or use royal mail!

Read the website. If you are confused then understand that Payday Express, The Money Shop & MEM Consumer Finance (PDUK etc) became Instant Cash Loans Ltd. 

The time to put in a creditor claim etc to have the balance wiped is gone. Realistically all you can do is see what happens with CRS.

Not to scare you but they can be very Litigious - So you might want to get your ducks lined up ready if it happens.

I'm assuming as if all they can send as a CCA was what they sent me in the first post that this doesn't constitute a CCA anyway.

So they would come unstuck if they went further as they've not provided the required documentation!

No a CCA Request is a document that legally binds you under the Consumer Credit Act. It should contain all the prescribed terms of the Credit Agreement.

Did the email contain any attachments? 

 

an you post it up minus personal details? Or screenshot it so we can see it in its original context.

well they can't issue a letter of claim via text/email it must be posted by royal mail.

pers I ensure these interlopers have your correct address...send a new CCA request by royal mail.

Just got this as an email from them...

 

Now I'm confused as to who to send a new CCA too

 

 

Thank you for your email, 

Payments need to be made to CRS, our client still owns this debt.

If you need confirmation of this from our client then please contact them.

Contact will resume until an arrangement is set up by yourself.

CCA request always goes to the owner of a debt

for better understanding see who is listed as that on your credit file.

I checked my credit file. And it shows it being to instant cash loans. 

 

So, do I use the address given for Instant Cash Loans as they appear to have all but gone for the CCA?

I could email the idiots at CRS to ask who currently owns this particular debt as well.

you should not ever be using email.

better to send one more email and state it is not to be used further to CRS.
