Buyer beware,

 

I brought a Yamaha mt-07 with this company, and I'll admit that I didn't read the small print, like anyone ever does,

 

about a year after buying the bike,

I decided to look at the finance papers and to my disbelief they had charged for a new Yamaha mt-09,

I had brought a yamaha mt-07 which it says quite clearly on the paperwork.

 

I rang the the dealer who said not surprisingly it was down to who I'd had finance with,

I'd had quite a lot of finance with them before and had no trouble,

I thought it would be a simple enough task to correct the problem,

 

to my surprise they weren't interested and because I had the bike for over a year, they said I had accepted that the goods were mine,

as it stands I have refused to pay as I am paying for something I dont actually own

 

surely this must be FRAUD?

CAN ANYONE HELP PLEASE.

Is the financial figure correct for the bike you have? Or is it the more expensive bikes' one!

It's the more expensive bike price, it lists the more expensive model on the finance papers,

I think from memory I've been charged about 10k, when I should of been paying about 7k,

 

the registration number coincides with the bike I have

,but the paperwork says it's the next model up

 

,I originally brought the bike as ex demo for 5k, I saw another bike so I sold the yamaha mt-07 and brought a different bike,

after a week I regretted my decision and decided to buy the yamaha mt-07 back

 

,it wasn't until about a year later I looked at the paperwork and then realized that they had charged me for a brand new Yamaha mt-09.

 

The FCA's didnt want to know, so I just gave up ,I still have all the paperwork I've been sent.

well its not fraud and you should be paying.

the simple fact that the wrong model was select and led to a higher finance doesn't mean you don't owe the money.

 

I wouls also suspect the vin plate is on the agreement too.

so I can't see why MN wont revise the agreement..

 

nothing to do with the FCA..FOS poss, but you'd have to expire MN's complaints procedure.

I don't deny owing some money,and I never refused to pay, but like you say they should amend the agreement but they wont,they say its down to the dealer, they're not interested, I have god knows how many letters to prove it.

if you already have a deadlock letter..

then goto the fos with it all.

 

the bottom line is you owe money, that should not cause you to believe you can cease payments though..

so you want them to take it away because of a small error on a computer printout. The bike is the one you bought, you agree to the terms of the loan and they agreed to lend you the money.

If you can show that they would have used a lower interest rate if the bike was shown as the correct model them you have somehting to take to the financial ombudsman but just spitting your dummy out and refusing to pay what is owed is stupid. They lent you money and their hold in the title to the bike is the guarantee the loan will be repaid. You still owe the money and that would be so if you had spent  borrowed money on champagne instead and had nothing to show for it, you have completely misunderstood how the financial world works.

the bike is the one you wnated and will own in full if you keep up the payments. Try and find out f there would be a difference in interest charged on the loan andget the loan reduced if there is.

No I don't want them to take it away, I want them to take the £3000 extra they have charged me for a brand new bike,I've never had.Then I might think about paying,your telling me that you would pay for something you have never owned,if it was just a typo then why wont they correct it,its like buying a jag and driving home in a mini.

Do you owe more than the £300?

If you do then get paying it back under the signed agreement.

 

Worry about the finer points later.

 

Or simply pay till the point of what you don't think you owe is left.

Being pigheaded is stupid imho
