Car hire damage being chased by Shakespeare Martineau

Hello,

my daughter was in a car accident and was given a loan car from a policy she bought with her finance.  

The car was delivered to her home on 27th December 2019 and collected on 15th January 2020.  

 

Subsequently , she was sent a letter to say the car had some damage on one of the wheels which she emailed back a letter disputing the damage was caused while the car was in her possession and requested photographic/video evidence of the car at the time it was delivered and picked up from her home (she didn't take any photos or video herself).  

 

This email was ignored and now she has had a letter from a bailiff saying they have added another £40 late payment fee and that this must be paid by tomorrow.  

 

Grateful for any advice on how to proceed! or what forum I should post this on. MTIA

no she hasn't got a letter from a bailiff.

 

she has a letter from a powerless Debt collection agency.

 

a DCA is NOT A BAILIFF

and have

ZERO legal powers on ANY DEBT , no matter it's type

Yes, that's what I meant, she has received a letter from a debt collector - Shakespeare Martineau.

Shakespeare Martineau are a solicitor not a DCA. but can also (as here) act as a powerless dca too, as most mugs think they are bailiffs with magical powers...…. as you did..

 

as long as it's not a letter of claim from them on behalf of their Client,  'the car hire company',  with a response pack giving 30days to reply

you are quite safe to totally ignore everything.

Thank you dx100uk - Here is the letter they sent.  Definitely not received a response pack.  Doesn't she need to reply to Europcar to get a reply from her previous correspondence?

and equally importantly they didnt go over the vehicle upon its return and agree anything with her about the state of the vehicle at the hand back.

They have the burden of proof it was damaged whislt in her care and they cant

Thanks so much for your replies.  They gave her deposit back a week or so after they collected the car, they wouldn't have done that if the car had any damage.
