ECP ANPR PCN - Overstay - Esso Meads Purfleet ***CANCELLED BY ESSO***

Hello, 

Have just received a PCN from ECP via email from my employer's fleet department. 

It is for an overstay at Esso in Purfleet. 

 

My excuse: wasn't aware of the requirement to pay as tiny signs etc... (not local but had a look on Google Maps to remind myself of the location). 

 

Currently the PCN has been sent to my employer (large car manufacturer) as it's a management scheme car, so they are the registered keeper of the car. 

My employer have said they do not require proof of payment. 

 

Should I ask them to confirm to Euro Car Parks I was the person driving or am I best ignoring it as any threat of legal action will go to my employer not me? 

Are ECP less likley to pursue a large multinational than an individual?

 

Any help is much appreciated!

17th March 2020

 

2 Date on the NTK [this must have been received within 14 days from the 'offence' date]

24th March 2020

 

 

3 Date received

26th March

 

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?]

Yes

 

5 Is there any photographic evidence of the event?

Yes - pics show numberplate at entry / exit

 

6 Have you appealed? [Y/N?] post up your appeal]

No

 

Have you had a response? [Y/N?] post it up

NA

 

7 Who is the parking company?

Euro Car Parks

 

8. Where exactly [carpark name and town]

Esso, Arterial Road, Purfleet

 

For either option, does it say which appeals body they operate under.

no harm in writing to ECP simply confirming you were the driver

that will remove your fleet management/employer from the loop.

I will contact ECP then to remove my employer from the loop.

 

I've read the posts you linked to and as successfully done by another person who was fined, I will contact MFG who operate the Esso garage to see if they'll help.

 

I'll let you know the outcome....

garage owned by the biggest chain of petrol retailers in the UK and they dont give a stuff about their customersand wont intervene.

however, over the last month slaes will have fallen 50% so any bad publicity may make them reconsider ther previous position.

Bearing that in mind ECP havent been keen to take peopel to court over this site because of their laughably rubbish signage. both its siting and its content are pants

Well, much easier to sort this than expected!

 

Messaged MFG yesterday (found a previous thread where someone had been fined at the same place and had also done this).  They asked for a receipt to confirm I'd spent money there, or a screenshot from my bank (fortunately I had used my card and not cash) so duly sent this over to them and by end of yesterday I had confirmation that they would cancel the fine this time round...

 

Here is MFG's reply:

 

"After reviewing your case, on this occasion as a gesture of goodwill I will cancel your parking fine for you – please consider this now cancelled. Please ensure that in the future you read the signage at our sites and adhere to the timeframe mentioned, there are multiple signs up around our sites advising the time limit and fine details. If you are going to be longer that the specified time, please mark yourself exempt with the staff onsite.

 

I hope this helps, if you find yourself with any other questions, don’t hesitate to ask.

BTW, both you & the garage refer to a "fine".  The PPC companies call the rubbish they send out a "PCN" (parking charge notice) which by complete coincidence has the same initials as the penalties that councils issue for parking offences (penalty charge notice).  Funny that!

 

The PPCs try to con people into thinking what they send has some sort of official standing, when it doesn't.  It's not a fine.  It's an invoice, no different from an invoice you'd get if you bought something on Amazon, for example.
