Point 2 is a complete mistake on the courts part because i've email proof form the court clerk i sent all information back to do with that order and its obviously was never put in the file.

Yes but if you had attached that to the above post 21 posts back and 3 hours ago .....it would of greatly assisted me and possibly changed the advice I gave you...why make hard work of everything ?

Seek advice from your court before spending any further the claim.

And should you get the courts permission to reserve...don't forget to inform the defendant first and issue fresh Pre Action Protocol.. letter before claim and give them the chance to settle first without a claim.

 

Otherwise your second claim will fail.
