Hi all, 

 

I once again need your advice on where I stand with this query below. Your input is very much valued. Any advice would be appreciated, thank you in advance.

Dear Sir/Madam,
Thank you for your response.
But I have now paid for a game where completion is impossible, because
he game is faulty. As a consumer, I believe I have the right to a refund
for a faulty product.
Whether this is sent to me as new nintendo e-voucher or paid in gold
coins on my account so that I can purchase something else within the
nintendo e-store.
I await your response.

We noticed that the funds you used when buying the game were added
by an eShop card.
Unfortunately, even as an exception, the refund will not be possible.
We do not refund amounts added by eShop cards.
We regret not being able to give you a more positive response but we
hope you will continue to enjoy your Nintendo products.

how did you buy or fund the eshop card that purchased the faulty game?

I purchased a nintendo e-shop voucher from Argos and then added to my nintendo account.

god it get worse,

well argos wont refund as the card was not faulty so don't bother asking

your bank wont refund the payment made to get the card from argos as the card was not faulty.

 

can you ask for a replacement download of the game.

or get them to diagnose the issue, so confirming its not completing?

 

when was the game purchase please?

Also, what was the value of the card and where is Nintendo – do they have a base in the UK?

The talking rubbish about no refunds. Of course you can get a refund – it's just a question of persuading/forcing them to see the light

The value of the card was £25. I purchased it last Thursday 20th. I did a search online and it seems it's not just me having this issue.

Okay, are you prepared to bring a small claim in the County Court? If you don't know what that means then have read around this forum about small claims in the County Court and see the steps. It's very easy.

Also, for this kind of money they will put their hands up and you will get your court fee back as well as your money – and you will have taught them a lesson which you can spread around the Internet.

They want to play games? Here's a game for them.

You will have to be able to demonstrate that the game was faulty. This may include taking a screen video of what is happening.

electronic goods bought within 14 days

under GDPR you don't even need a reason to get a full refund within 14 days.
