Hi everyone 

 

I need a bit of help getting the income a company I worked for last year to change how much they paid me on HMRC. 

 

last tax year I worked for two companies and went self employed. The first company paid me fine with no problems but the second one messed up completely. I started working for them at the end of July 2018 and got terminated at the end of September 2018. In this time I only ever received one payslip from the company and 5 payments. Yes I know already confusing but it gets better. The payslip doesn’t match up with the payments even with taking tax and NI into account. And the HMRC records don’t match up with either the payments or the one payslip. 
 

The payslip says the following:

 

Payments

Basic Pay: £1,500.00

Commission: £620.00

Pay Date: 25/09/2018

Total Payment: £2,120.00

 

Deductions

Car Park: £30.00

Commission Advance: £434.00

PAYE: £424.00

NI: £170.16

Total Deductions: £1,061.84

 

Net Pay: £1,061.84

 

What HMRC says

The payments I received

Total £2,757.25

 

So as you can see they don’t match up and my problem now is I only found out it was different on HMRC after my accountant submitted my self assessment for 2018 to 2019 with what my payslip said I was paid. So now my self assessment is wrong and HMRC records are wrong. I submitted a form telling them that the company had it wrong and they just sent me a letter saying I need to contact the company. 
 

I would really appreciate any help anyone can give me about contacting the company and getting this all sorted out.

why not send them a copy of your pay slips and get them to correct HMRC records they previously sent?

if everyone stopped blindly paying DCA's tomorrow

the biggest financial industry in the UK, the whole DCA industry would collapse overnight.

What should I put in the letter to the old company? I’m only asking because a few people who use to work there have said they messed up there payments and they seem to be known for ignoring complaints and not paying people right.

why not send them a copy of your pay slips and get them to correct HMRC records they previously sent?

At first I thought Class 1 NIC may have been the problem but you mention NIC deductions above.

 

If we address only the  Co that you have the problem with, you say you worked for them July to September 2018 but they paid you in August through to November.

 

So were you paid in arrears.

 

Was there any PAYE Code showing on any payslip to say what code was being used against your pay.

I was paid two months in arrears but according to the numbers they’ve put on HMRC I was paid about £300 to £400 more then I actually got paid. 
 

Im not sure if I should just write to them to explain this and fix it but I don’t no how long I’ve got to fix the records because I get in trouble.

Hi Ft,

 

You didn't say if there was any tax code on the payslip you had. There may be no tax code as they deducted 20% tax from all earnings but please confirm anyway.

 

Write to the company saying you only received 1 payslip and require copies of all payslips relevant to your work period. This is because you believe the figures reported to HMRC may be inaccurate.

 

I suggest you send a typed letter and use Royal Mail Signed For delivery.

 

Have you completed a tax return for the year to 5/4/19 ?

The tax code on the payslip is 0T/1

 

Would the following be okay for a letter to the company?

 

Dear Sir/Madam 

 

I only received one pay-slip from your company when I was employed between July 2018 to September 2018. I require copies of all my pay-slips relevant to my work period as I believe the figures that was reported to HMRC to be wrong.

Ok, the tax code OT/1 means they should have taken 20% tax from everything you earned.

 

I sugest the letter is slightly different :-

 

Dear Sir/Madam 

 

I only received one pay-slip from your company when I was employed between July 2018 to September 2018.

 

I believe the figures reported to HMRC may be wrong and would you please now supply copy payslips for the period worked; or could you confirm in writing the gross pay and tax figures so I can clarify this issue with HMRC.

I suggest you hold off telling HMRC for now.

 

Actually contacting them may be difficult in itself, and there's no point in telling HMRC until you're sure there's an error.

Looking again at the figures in your post #1 above, I see you made an error :-

 

Payments

Basic Pay: £1,500.00

Commission: £620.00

Pay Date: 25/09/2018

Total Payment: £2,120.00

 

Deductions

Car Park: £30.00

Commission Advance: £434.00

PAYE: £424.00

NI: £170.16

Total Deductions: £1,061.84

 

Net Pay: £1,061.84  -  I think this figure should be  £1,495.84 being Pay + commission; less (car park of £30.00, tax at 20%  £434.00, NI of £170.16)

 

I guess you duplicated the "Net Pay" figure in error but does my suggestion in red make more sense. 

 

Also, if you apply my process to your figures, do they make any more sense.

 

Taking the pay and deductions reported to HMRC, I reckon you received £407.00 less than you should have. However, the Commission Advance was £434 - was this paid in cash and how many Car Park deductions of £30 were taken from you.

Sorry I’ve been a bit busy with getting a new car and sorting out stuff for whatever happens over the next few weeks. 
 

the Net pay is correct and I was never paid any cash all I was ever paid was what went into my bank account. Also I don’t no the answer to the car park as I only ever received one pay slip. 
 

I’ll upload a copy for you encase I’ve missed anything.

Also I haven’t received anything yet from the letter I sent to the company. I just checked companies house and the company status is liquidation.

Hi Ftgab,

 

Ok so this payslip makes sense but without any others, it's difficult to reconcile what you were paid and what deductions made.

 

If the company is now in liquidation, your only hope to dispute the amount paid was to produce payslips. Without these, the only evidence you can show HMRC is bank statements and, even then,  they may not accept  the figures given to them by the employer were wrong.

 

Getting payslips at the time was critical and it may now simply be too late.

 

Theoretically, you could go to the Liquidator dealing with the Co's affairs and seek confirmation about the pay and deductions. Other than that, you may have to let this go and move forward.

How would I go about contacting the liquidator and what should I do about my self assessment as I filled it out with the total pay from the above payslip not the details given to HMRC? I didn’t find out there was a difference until after my accountant submitted my self assessment.

If the company has a website, it should show who the Liquidator is and you could adjust the letter above (in post#10) to send to them instead of the company itself. However, the Liquidator is likely to only have the same data as that sent in to HMRC.

 

Without knowing the GROSS pay and deductions taken from it, calculating the true figures may be impossible. In particular, the following figures given by HMRC make no sense :-

 

31/12/18             1,343.62 pay                      71.00 tax                              76.99 NIC

 

If the Co. used the tax code 0T/1 (no personal allowances and no account to be taken of cumulative pay and tax figures in the year to date) properly, tax of 268.60 should have been deducted.

 

In the circumstances, you're not likely to succeed in challenging the figures which HMRC used but I really think your accountant should be the one to properly advise you on this matter.

 

My advice would be to let this go - getting it changed may be impossible and not worth the time and effort.

Okay if there’s no point getting it changed what should I do about the self assessment that’s wrong if I drop this. 
 

Because I was due a rebate since my profit for the year after expenses was under £7000. But as you can see with the companies I worked for before going self employed I paid tax and NI.

Have a word with your accountant who should be able to tell you if you're due a rebate, and how much.

 

You need to tell them the figures used by HMRC as I assume the figures differ from those submitted by the accountant when doing the 2018/19 tax return.
